JBS and Smithfield Pork Class Action Lawsuit

Two Pork Class Action Settlements totalling $101,864,300 involving Pork have been settled as a result of class action lawsuits. The lawsuits involve two pork producing companies and involve price-fixing, anti-competitive behavior alleged in the class action lawsuit. The pork producing companies, Smithfield, and JBS, have agreed to pay $101,864,300 to consumers of certain pork products. Smithfield agreed to pay $24,500,000, while Smithfield has agreed to pay $77,364,300. The deadline to file a claim in this class action settlement has passed.

The companies are accused of having conspired in an intentional restraint of trade, the purpose and effect of which was to suppress competition and to allow pork producers to charge supra-competitive prices for Pork products during the Settlement Class Period, in violation of federal anti-trust, price-fixing and monopolization laws. It is alleged that Smithfield and JBS perpetrated "stabilizing" the price of Pork products, beginning at least as early as January 1, 2009. Direct purchasers of their brands or their subsidiaries' brands could seek payments by filing a timely claim by June 14, 2022.

The Court has not decided whether JBS or Smithfield did anything wrong, and both JBS and Smithfield deny any wrongdoing.

How Do I Qualify?

You are included in this class action if you purchased Pork *directly* from any of the Defendants or any co-conspirator, or their respective subsidiaries or affiliates for use or delivery in the United States from January 1, 2009, through January 12, 2021. Some examples of Smithfield brands are as follows:

• Farmland

How Do I File a Claim?

To be eligible to receive a payment from any of the settlements, you must have completed and submitted a timely Claim Form before June 14, 2022. The class action is now closed. The related pork price-fixing settlement is also closed; its deadline was June 30, 2023.
