California residents: Your specific rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), are described in our dedicated CCPA / CPRA Notice & Privacy Choices. The CCPA Notice includes the categories of personal information we collect, sources, retention periods, the third-party categories we share with, your right to know / delete / correct / opt-out / appeal, and a one-click opt-out from sale and sharing. We also automatically honor the Global Privacy Control (GPC) browser signal as a valid opt-out request, as required by 11 CCR §7025.

Submitting content on OpenClassActions.com or via the online forms hosted on this site in relation to a law firm or an attorney does not establish an attorney-client relationship between you and them. It is crucial to understand that hiring a lawyer is a significant decision and should not be solely based on advertisements.

At OpenClassActions.com, we help connect people with potential class action settlements and legal claims — but it's important to understand what we do and don't do.

This site shares information about lawsuits, settlements, and legal opportunities that may be available to you based on your situation. It's not legal advice, and visiting or filling out any forms on this site doesn't automatically mean you are agreeing to hire any lawyers that advertise or are linked to by OpenClassActions.com. OpenClassActions.com is not a law firm, and we do not provide legal advice. We simply help you find information about class action lawsuits and settlements that may be relevant to you.

If it looks like you qualify for a case, one of the law firms we work with may in some cases offer to represent you. But that only happens if both sides agree in writing.

We don't guarantee results. Every case is different, and just because other lawsuits have paid out doesn't mean yours will. If a law firm does take your case, the agreement is between you and the law firm, and OpenClassActions.com is not a party in any way to any agreements.

OpenClassActions.com (OCA) values its users' privacy. This Privacy Policy ("Policy") will help you understand how we collect and use personal information from those who visit our website or make use of our online facilities and services, and what we will and will not do with the information we collect. Our Policy has been designed and created to ensure those affiliated with OpenClassActions.com of our commitment and realization of our obligation not only to meet, but to exceed, most existing privacy standards.

We reserve the right to make changes to this Policy at any given time. If you want to make sure that you are up to date with the latest changes, we advise you to frequently visit this page. If at any point in time OpenClassActions.com decides to make use of any personally identifiable information on file, in a manner vastly different from that which was stated when this information was initially collected, the user or users shall be promptly notified by email. Users at that time shall have the option as to whether to permit the use of their information in this separate manner.

This Policy applies to OpenClassActions.com, and it governs any and all data collection and usage by us. Through the use of openclassactions.com, you are therefore consenting to the data collection procedures expressed in this Policy.

Please note that this Policy does not govern the collection and use of information by companies that OpenClassActions.com does not control, nor by individuals not employed or managed by us. If you visit a website that we mention or link to, be sure to review its privacy policy before providing the site with information. It is highly recommended and suggested that you review the privacy policies and statements of any website you choose to use or frequent to better understand the way in which websites garner, make use of and share the information collected. Specifically, this Policy will inform you of the following:

1. What personally identifiable information is collected from you through our website; 2. Why we collect personally identifiable information and the legal basis for such collection; 3. How we use the collected information and with whom it may be shared; 4. What choices are available to you regarding the use of your data; and 5. The security procedures in place to protect the misuse of your information.

Information We Collect

It is always up to you whether to disclose personally identifiable information to us, although if you elect not to do so, we reserve the right not to register you as a user or provide you with any products or services. This website collects various types of information, such as:

Information automatically collected when visiting our website, which may include cookies, third party tracking technologies and server logs. OpenClassActions.com may have the occasion to collect non-personal anonymous demographic information, such as age, gender, household income, political affiliation, race and religion, as well as the type of browser you are using, IP address, or type of operating system, which will assist us in providing and maintaining superior quality service.

OpenClassActions.com may also deem it necessary, from time to time, to follow websites that our users may frequent to gleam what types of services and products may be the most popular to customers or the general public. Please rest assured that this site will only collect personal information that you knowingly and willingly provide to us by way of surveys, completed membership forms, and emails. It is the intent of this site to use personal information only for the purpose for which it was requested, and any additional uses specifically provided for on this Policy.

Why We Collect Information and For How Long

We are collecting your data for several reasons:

• To better understand your needs and provide you with the services you have requested;
• To fulfill our legitimate interest in improving our services and products;
• To send you promotional emails containing information we think you may like when we have your consent to do so;
• To contact you to fill out surveys or participate in other types of market research, when we have your consent to do so;
• To customize our website according to your online behavior and personal preferences.

The data we collect from you will be stored for no longer than necessary. The length of time we retain said information will be determined based upon the following criteria: the length of time your personal information remains relevant; the length of time it is reasonable to keep records to demonstrate that we have fulfilled our duties and obligations; any limitation periods within which claims might be made; any retention periods prescribed by law or recommended by regulators, professional bodies or associations; the type of contract we have with you, the existence of your consent, and our legitimate interest in keeping such information as stated in this Policy.

For California residents, specific retention windows for each category of personal information — including newsletter subscriptions, contact-form submissions, server logs, analytics data, and CCPA request records — are listed in the Retention table on our CCPA / CPRA Notice, as required by Cal. Civ. Code §1798.100(a)(3).

Automated decision-making: OpenClassActions.com does not use automated decision-making technology (ADMT), profiling, or AI-driven systems to make decisions that produce legal or similarly significant effects on visitors. See the Automated Decision-Making section of our CCPA Notice for details.

Submission of Information

Phone calls and text messages (TCPA notice): We will only call or send SMS messages to a phone number you provide if you have given us prior express written consent at the form where you submitted that number — for example, by checking a clearly labeled consent checkbox next to the phone-number field. Submitting a phone number through any form that does not include such an affirmative checkbox is not consent to be contacted by phone or text. You can revoke any prior consent at any time by replying STOP to a text message or by emailing privacy@openclassactions.com. Message and data rates may apply where you have opted in. Consent to receive marketing calls or texts is not a condition of purchase or of receiving any benefit.

By submitting information to us, you agree and understand that we, our affiliates, or third-parties providing services to us may contact you directly should we have any interest in discussing your potential eligibility for related claims posted on this website — primarily by email — unless you request in writing your desire not to be contacted. Phone calls and SMS text messages are sent only where the form-specific consent described above has been provided. By submitting information to us via forms hosted on our website, you also agree that we, our affiliates, or third-parties providing services to us may use your contact information to send you electronic newsletters in accordance with this Policy.

In the event you submit information through the Site, you agree to provide true, accurate, current and complete information and agree to promptly update the information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, and/or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your participation in the Site and/or refuse any and all current or future use of the Site or its services (or any portion thereof).

OpenClassActions.com may collect and may make use of personal information to assist in the operation of our website and to ensure delivery of the services you need and request. At times, we may find it necessary to use personally identifiable information as a means to keep you informed of other possible products and/or services that may be available to you from openclassactions.com.

OpenClassActions.com may also be in contact with you with regards to completing surveys and/or research questionnaires related to your opinion of current or potential future services that may be offered.

OpenClassActions.com may find it necessary, from time to time, to contact you on behalf of our other external business partners with regards to a potential new offer which may be of interest to you. If you consent or show interest in presented offers, then, at that time, specific identifiable information, such as name, email address and/or telephone number, may be shared with the third party.

OpenClassActions.com may find it beneficial to all our customers to share specific data with our trusted partners in an effort to conduct statistical analysis, provide you with email and/or postal mail, deliver support and/or arrange for deliveries to be made. Those third parties shall be strictly prohibited from making use of your personal information, other than to deliver those services which you requested, and as such they are required, in accordance with this agreement, to maintain the strictest of confidentiality with regards to all your information.

OpenClassActions.com uses various third-party social media features including but not limited to Twitter, Facebook, Instagram, Reddit, LinkedIn, or email services such as Mailchimp, and other interactive programs. These may collect your IP address and require cookies to work properly. These services are governed by the privacy policies of the providers and are not within OpenClassActions.com's control.

Indemnity

You agree to indemnify and hold us, and our subsidiaries, affiliates, directors, officers, agents, third party contractors and employees, harmless from all damages, costs, liabilities, and any claim or demand made by any third party, including reasonable attorneys' fees due to or arising out of Content you submit, post to or transmit through the Site, your use of the Site, your connection to the Site, your violation of this agreement, or your violation of any rights of another person, or due to or arising from such activities carried out by a person using your Site account or password, with your knowledge.

Disclosure of Information

OpenClassActions.com may not use or disclose the information provided by you except under the following circumstances:

• as necessary to provide services or products you have ordered
• in other ways described in this Policy or to which you have otherwise consented
• in the aggregate with other information in such a way so that your identity cannot reasonably be determined
• as required by law, or in response to a subpoena or search warrant
• to outside auditors who have agreed to keep the information confidential
• as necessary to enforce the Terms of Service
• as necessary to maintain, safeguard and preserve all the rights and property of OpenClassActions.com.

Non-Marketing Purposes

OpenClassActions.com greatly respects your privacy. We do maintain and reserve the right to contact you if needed for non-marketing purposes (such as bug alerts, security breaches, account issues, and/or changes in OpenClassActions.com products and services). In certain circumstances, we may use our website, newspapers, or other public means to post a notice.

Children, Minors, and the CCPA Opt-In Requirement

OpenClassActions.com's website is not directed to, and does not knowingly collect personally identifiable information from, children under the age of thirteen (13), consistent with the federal Children's Online Privacy Protection Act (COPPA). If it is determined that such information has been inadvertently collected from anyone under thirteen, we will promptly delete it from our systems or alternatively obtain verifiable parental consent for its use and storage.

Under the California Consumer Privacy Act, the sale or sharing of personal information of a consumer under 16 additionally requires affirmative opt-in consent — from the consumer if they are 13 to 15, or from a parent or guardian if they are under 13. Because we do not knowingly process the personal information of consumers under 16, no opt-in is sought. If you are a parent or guardian and believe we have inadvertently collected information from a minor, please contact us at ccpa@openclassactions.com and we will delete it.

Unsubscribe or Opt-Out

All users and visitors to our website have the option to discontinue receiving communications from us by way of email or newsletters. To discontinue or unsubscribe from our website please send an email that you wish to unsubscribe to info@openclassactions.com. If you wish to unsubscribe or opt-out from any third-party websites that are not under the control of OpenClassActions, you must go to that specific website to unsubscribe or opt-out.

Opt out of analytics and personalized advertising: California residents (and any visitor who prefers not to be tracked for cross-context behavioral advertising) have three equally effective ways to opt out:

• Click the Opt Out of Sale & Sharing button on our CCPA / CPRA Notice & Privacy Choices page. This sets a persistent first-party cookie that disables Google Analytics, Google Ads conversion tracking, and personalized AdSense targeting on this browser for one year.
• Enable Global Privacy Control (GPC) in your browser. We detect the GPC signal both server-side (via the Sec-GPC request header) and client-side (via navigator.globalPrivacyControl) and automatically opt the session out of sale and sharing on every page load — no further action needed. Many privacy-focused browsers (Brave, DuckDuckGo) send GPC by default; Firefox and Chrome support it via built-in setting or extension.
• Email ccpa@openclassactions.com with the subject line "Do Not Sell or Share My Personal Information."

You may also use Google's Google Analytics Opt-out Browser Add-on as an additional layer.

Website Usage Disclosure and Analytics Disclosure

We may collect certain information automatically when you visit our website, including:

• IP address
• Browser type and version
• Operating system
• Pages viewed and time spent on pages
• Referring/exit pages
• Date and time of visit
• Click patterns

This information is collected using cookies, web beacons, and similar technologies. We use this data to analyze trends, administer the site, track users' movements around the site, and gather demographic information about our user base as a whole.

We utilize third-party analytics services, including Google Analytics or Taboola, to help us understand how visitors engage with our website. These services may collect information about your online activities over time and across different websites. They may use this information to provide us with aggregated data about site traffic and usage.

The analytics providers may combine the information collected on our site with data from other sources. However, we do not allow these third parties to collect or access any personally identifiable information through our website. The data is used in aggregate form only for analytical purposes.

You can opt out of data collection by analytics services like Google Analytics by installing browser add-ons or adjusting your browser settings to block cookies and tracking technologies. However, this may impact some functionality of the website.

We do not sell personal information for monetary consideration. We do not transfer personal information to Facebook, Google, or any other third party for that third party's own independent marketing purposes. We do, however, use third-party analytics and advertising tools (including Google Analytics, Google Ads, and Google AdSense) that may receive pseudonymous identifiers (such as IP address, cookie IDs, and device information). Under the California Privacy Rights Act's broad definitions, those flows can constitute "sharing" for cross-context behavioral advertising and, in some configurations, a "sale." California residents have the right to opt out of all such sharing in one click via our CCPA / CPRA Notice & Privacy Choices page, and our servers automatically honor the Global Privacy Control browser signal as a valid opt-out.

Note — this opt-out is separate from email unsubscribe. Opting out of sale or sharing (via the button on the CCPA page or via your browser's Global Privacy Control signal) controls cross-context behavioral advertising and analytics on this browser. It does not unsubscribe you from any newsletter or other email subscription you previously joined. To stop receiving emails, click the unsubscribe link in any email we send you, reply STOP, or email info@openclassactions.com.

The computers and servers in which we store personally identifiable information are kept in a secure environment. This is all done to prevent any loss, misuse, unauthorized access, disclosure or modification of the user's personal information under our control.

The company also uses Secure Socket Layer (SSL) for authentication and private communications to build users' trust and confidence in the internet and website use by providing simple and secure access and communication.
