What's The RCN Class Action Settlement About?

A $11,500,000 Class Action Lawsuit has been Settled with telecom provider of internet services RCN. If you are or were a customer of RCN and paid padded billing fees, you may have been eligible for a CASH class action payout or credit towards your bill. Previously, RCN had settled a class action lawsuit for $6.6 Million over late fees that also allegedly violated New Jersey Consumer Protection laws.

The originating class action lawsuit was filed against RCN Telecom on behalf of customers who were allegedly charged and paid a "NAM" Fee on their RCN broadband internet service bill. The "NAM" fee stands for Network Access (and) Management.

The RCN Class Action Settlement settles a lawsuit that alleged that certain RCN fees for internet were in violation of the New Jersey Consumer Fraud Act. According to the original RCN class action lawsuit, this is a bait-and-switch tactic used by RCN to add additional padding to bills in order to make more money off of customers. This RCN settlement seeks to resolve the $30 Million or so tht RCN has garnered as a result of allegedly padded internet bills to over 400,000 RCN customers. While RCN offered a flat monthly rate, they padded customer bills with an inexplicable "Network Access and Maintenance" fee.

The RCN Class Action Lawsuit alleged that RCN broadband Internet charged customers this padded fee in violation of New Jersey law, including the New Jersey Consumer Fraud Act. Consumers in the following states are affected, according the RCN class action, but anyone in the United States that believes they qualify can file a claim.

How Do I Qualify?

All current and former customers in the United States who received internet services from RCN Entities (eee the full list of RCN settlement entities above) and who were charged and paid a "Network Access and Maintenance" fee from November 1, 2017 through September 13, 2022 may qualify for the RCN class action settlement and payout.

What Can I Get?

Class Members who were charged and paid "Network Access and Maintenance" fees for broadband Internet service by an RCN Telecom operating company and who file valid claims will receive their choice of either a bill credit (if you're still a customer at the time of payout) or a check or electronic payment, options which will be made available from the Settlement fund of $11,500,000. The total refund amount per qualified claim will depend on meeting the following settlement criterea:

• Whether you choose in your claim form to receive a cash check mailed to you or electronic payment and,
• When you were a subscriber (whether it was in the claim form period of November 1, 2017 to September 13, 2022)
• The number of other claimants,

The settlement payout per claim for the RCN class action is estimated to range somewhere between $0.20 and $159.82 depending on how long you were subscribed to RCN broadband internet for, as well as what period of time over the course of having RCN internet services you were charged the "Network Access and Maintenance" fee.

The Court will hold a Final Approval Hearing to decide on the future of the class actions settlement and its details on January 26, 2023 9:30AM Eastern Time via Zoom.
