What's This Settlement About?

A $2,300,000 settlement has been reached against ABM Industry Groups, LLC. The settlement fund will be distributed to class members as a result of a lawsuit in which it was alleged that ABM Industry Groups violated California state labor laws and have made the following claims for relief as a result of the alleged law. These are a list of alleged wrongdoing on the part of ABM Industry Groups:

(a) failure to pay wages, including minimum wages;

(b) failure to pay overtime wages;

(c) failure to provide proper meal periods, and to properly provide premium pay in lieu thereof (limited to the members of the Supervisor Meal and Rest Break Settlement Class);

(d) failure to authorize and permit rest breaks, and to properly provide premium pay in lieu thereof (limited to the members of the Supervisor Meal and Rest Break Subclass);

(e) improper and/or inaccurate wage statements;

(f) waiting time penalties for untimely pay of wages at the conclusion of employment;

(g) failure to provide employment records;

(h) failure to provide written notice of paid sick leave available;

(i) unfair business practices;

(j) failure to comply with employee bond laws regarding uniform deposits; and

(k) civil penalties under the Private Attorneys General Act (PAGA). PAGA is a law that was passed that allowes employees that were aggrieved, or in this case members of the class action, to recover civil penalties on behalf of themselves, other employees, and the State of California for Labor Code.

(l) The plaintiffs in this case, or class action members, also allege violations under the Federal Fair Labor Standards Act (“FLSA”). The FLSA is a federal law that establishes rights for employees regarding minimum wages, overtime pay, recordkeeping of wages and related information, and employment standards for youths.

• New Hire Wage Class: can get $21, plus another $10 if you opt into the FLSA Collective Action;
• Wage Statement Settlement Subclass: $50;

• Current Employee Uniform Deposit Settlement Subclass: Automatically a Qualified Claimant for the PAGA Settlement Group;
• Supervisor Meal and Rest Break Settlement Subclass: $20 per pay period worked.
