What's This Settlement About?

A class action settlelment has been reached that will pay consumers a one time check in the amount of $450. The lawsuit was over alleged phone calls that were made to consumers using automated systems. These automated systems attempted to market or sell Allstate insurance products.

The lawsuit stated that automated calls were made on behalf of Allstate to individuals who did not give prior express consent to receive such calls, and furthermore, that calls were made even though some of them were on the DNC Registry. The DNC registry allows you to register your number (either home or mobile) to avoid sellers and marketers from calling you to hock their products. The Class Representatives (who lead the evidence in the class action lawsuit) have alleged that this violated a federal statute called the Telephone Consumer Protection Act.

The Telephone Consumer Protection Act is a law that is aimed to restrict telephone telemarketing and automated telephone or mobile equipment The TCPA limits the use of dialing systems, artificial or prerecorded voice messages, SMS text messages, and even fax machines. It also specifies several technical requirements for fax machines, autodialers, and voice messaging systems—principally with provisions requiring identification and contact information of the business or entity using the automation to be contained in the message.

How Do I Qualify For Payment?

The Settlement provides relief for all Settlement Class Members, who are described as any person in the United States:

• who received one or more calls from AGAX,
• for the purpose of encouraging the purchase of Allstate goods or services
• the result call or calls were transferred to an Allstate agent(s)
• on or after September 23, 2016 up to and including October 1, 2021
• that originated from leads sold by Phoenix to Overstep.


How Do I File a Claim and Get Paid?

Each Settlement Class Member who submits a valid and timely Claim Form will receive a check for $450. You can submit claim form online by May 20, 2022.

The Final Approval Hearing was held at 1:30 p.m. on August 15, 2022, in Courtroom 3 of the U.S. District Court for the Southern District of Ohio.
