If you purchased a 12 oz cannister of "365 Organic Hot Cocoa Rich Chocolate Flavor Mix" or "365 Everyday Value Organic Hot Cocoa Rich Chocolate Flavor Mix" in California any time between November 3, 2017, and March 13, 2025 you may be owed an estimated $2.90 for each qualifying unit purchased from a new Whole Foods open class action settlement.
This settlement resolves claims that Whole Foods mislabeled the quantity of organic hot cocoa in canisters marketed in California, misleading consumers. Whole Foods denies all allegations and liability. The class action lawsuit alleged that Amazon and Whole Foods misrepresented the amount of cocoa mix in the cannisters due to non-functional empty space (slack-fill).
You may be eligible if you purchased the eligible hot cocoa product at Whole Foods Market in California or online while present in California between November 3, 2017 and March 13, 2025. If you are claiming that you purchased 2 items or fewer you may not be required to provide proof of purchase. If you purchased more than 2 items, you will need to provide proof of purchase, such as a receipt or other documentation showing the purchase.
