What's the Clearview AI Facial Recognition Privacy Class Action?
A massive AI privacy class action lawsuit, known as In re Clearview AI, Inc. Consumer Privacy Litigation, alleges that a business called Clearview AI violated privacy and computer data protection laws of various states in the U.S. According to the class action lawsuit, Clearview AI is accused of collecting facial images from public social media platforms like Meta (Facebook), Twitter, Instagram, and others without consent, storing this data in a searchable biometric "facial recognition" database, and then selling or providing access to this database. Clearview AI absolutely denies these allegations and any wrongdoing. However, the class action settlement is a compromise to end the lawsuit and avoid the uncertainties and costs associated with a trial, not an admission of guilt.
What's the Total Clearview AI Settlement Amount?
The Total class action settlement fund amount will vary depending on the outcome of future events:
1. If Clearview files for an initial public offering (IPO), the Settlement Fund will equal 23% of Clearview's shares as of September 6, 2023, multiplied by the public offering price listed in the final IPO prospectus.
2. If Clearview enters into certain transactions like a merger or sale of assets, the Settlement Fund will be a cash payment equal to what the Settlement Class would have received if it held 23% of Clearview's shares immediately prior to the transaction.
3. If neither of the above events occurs by December 31, 2027, the Settlement Master may require Clearview to fund the Settlement with a cash payment equal to 17% of Clearview's revenue from the date of Final Approval through the date of the Cash Demand.
How Do I Qualify For a Payout?
To qualify for a payout from the Clearview facial recognition privacy class action, you must be a member of the Settlement Class, which includes individuals who reside or resided in the United States and are 18 years of age or older, whose facial images may be stored in Clearview's Biometric Database.
There are also specific subclasses for residents of California, Illinois, New York, and Virginia. You must submit a valid Claim Form to be eligible for payment. If you received a notice by U.S. Mail or email, Clearview has likely already pre-identified you as a potential class member, but a notice may not be necessary in order to file a claim form. How Much Can I Get Paid?
The payment amount depends on your state of residence during the applicable time period:
1. Illinois residents: 10 shares of the Net Settlement Fund
2. California, New York, or Virginia residents: 5 shares of the Net Settlement Fund
3. Residents of other U.S. states: 1 share of the Net Settlement Fund
In effect, Illinois residents can get twice as much as California, New York, or Virginia residents, and ten times all other residents in the United States.
