Current Status

The court held the final approval hearing on March 13, 2024, then asked the parties for supplemental briefing, and entered the order granting final approval on July 18, 2024 — the same order that awarded class counsel roughly $2 million in fees. Class members have publicly reported receiving payments. What Was the Case About?

Plaintiffs alleged that Grande Cosmetics sold its GrandeLASH-MD, GrandeBROW and GrandeHAIR enhancement serums without disclosing that they contain isopropyl cloprostenate, a synthetic prostaglandin analog of the type found in prescription eye medications, and without warning purchasers of the adverse reactions the complaint attributed to that ingredient. The complaint claimed the serums were marketed as ordinary cosmetics even though, in the plaintiffs' account, the presence of that ingredient made that characterization misleading.

Grande Cosmetics denied the allegations and denied any liability or wrongdoing. The company has stated that its cosmetics and serums have not been found to contain dangerous substances and that the FDA has not determined that the products are unsafe or put consumers at risk of adverse effects. It agreed to the settlement to resolve the claims, and as part of the resolution agreed to update the products' labeling, including usage instructions and the wording used in the ingredient list.

The case is Nixon v. Grande Cosmetics, LLC, No. 1:22-cv-06639, filed in November 2022 in the U.S. District Court for the District of New Jersey. The court entered preliminary approval of the settlement on December 14, 2023, which is the date that closed the class period.

What Is Isopropyl Cloprostenate?

Isopropyl cloprostenate is a synthetic analog of prostaglandin, a hormone-like compound the body produces that takes part in a range of physiological processes. Prostaglandin analogs are used in prescription drugs for glaucoma, and one observed effect of that drug class is longer and thicker lashes — which is why analogs of this kind have appeared in over-the-counter lash, brow and hair serums. The dispute in this case was not about whether the ingredient works, but about whether its presence and its potential effects were adequately disclosed to purchasers.

Similar disclosure claims have been raised over other lash serums. A separate settlement covered Athena Cosmetics' RevitaLash and RevitaBrow eye serums, and another covered the Babe Lash eyelash and brow serums. Both of those claim windows have also closed.

Who Was Covered?

The settlement class covered current and former persons in the United States or its territories who purchased GrandeLASH-MD, GrandeBROW or GrandeHAIR serums for personal, family, household or professional purposes between January 1, 2018 and December 14, 2023, the date preliminary approval was entered. Reporting on the settlement put the class at roughly 800,000 to 1 million people. Standard exclusions applied to the defendant's officers, affiliates and related parties, and to others identified in the class notice.

What Were the Benefits?

The settlement established a $6,250,000 fund. A class member who filed a valid, timely claim was eligible for a base cash benefit of up to $150 without submitting proof of purchase. If money remained in the fund after the base benefits were paid, a repeat purchaser benefit of up to an additional $150 was available to claimants who documented purchases of two or more eligible products, for a maximum of up to $300.

Attorneys' fees, litigation costs, notice and administration expenses and service awards came out of the same fund, and the court approved a fee award of roughly $2 million. Because the fund was fixed and every approved claim shared it, the per-person payment was subject to pro rata reduction once the number of valid claims exceeded what the fund could pay at the estimated rate. The amounts class members have reported receiving are well below the $150 figure used in the notice.

What Proof Was Required?

The base cash benefit required no proof of purchase. A class member could complete the claim form online through the official settlement website or submit it by mail, attesting to their purchases under penalty of perjury. The form carried a Notice ID line, but it stated that a claimant who never received a notice, or who did not have a Notice ID, could leave that line blank without affecting eligibility for a settlement benefit — so filing did not depend on an administrator-issued code.

Documentation was required only for the additional repeat purchaser benefit. Acceptable forms of proof included physical receipts, online order receipts, an order confirmation from Grande Cosmetics or another retailer, cancelled checks, and credit card or bank statements showing the purchases.

What Happened With Payments?

Under the settlement terms, approved payments were to be issued electronically by Venmo, Zelle or virtual Mastercard unless a class member asked for a paper check by mail, and checks carried a six-month cashing window from the date printed on the check. Class members have publicly reported receiving payments from this settlement.

As of July 29, 2026, no official distribution date and no announcement that the distribution is complete had been located in public sources. Anyone who filed a claim should rely on the official settlement website and on the communications tied to their own claim; questions about a specific payment go through the contact page on the official settlement website.
