What is the Lyons Magnus Specialty Drink Class Action Lawsuit About?
A $3,500,000 class action lawsuit has been settled with Lyons Magnus Specialty Drink. The class action settlement is the end result of a 2022 FDA recall that affected dozens of popular products including a variety of drinks such as thickened dairy drinks, non-dairy beverages like almond-flavored Barista Style, plant protein drinks, along with nutritional drinks, protein shakes, and cold brew coffee with oat milk in different flavors.The Lyons Magnus class action lawsuit alleged that the defendant marketed some of its product in a deceptive manner by not informing consumers of the potential risk or hazard of containing certain dangerous bacterium such as Cronobacter sakazakii and Clostridium botulinum. According to the FDA recall, these bacterium could result in life threatening health risks from potential infections that compromise the immune system.
Lyons Magnus, LLC, the marketers and producer of the alleged products, has denied any wrongdoing and has not accepted any of the allegations, nor has the Court made any determination as to the validity of the claims on the class action lawsuit. However, Lyons Magnus has agreed to pay out a $3.5 Million settlement fund to qualifying claimants who purchased products that fell under the FDA's massive recall in 2022.
How Do I Qualify For A Payout?
In order to qualify for a payment or benefit from the Lyons Magnus Specialty Drink class action lawsuit, you must have been in the United States or one of its territories, and purchased one or more product units of recalled lots qualified products at any time from April 1, 2021 through October 27, 2022. The qualifying class action food or drink products must have been purchased for personal use, and not for resale.What Can I Get in the Lyons Magnus Specialty Drink Class Action Settlement?
Qualifying settlement class members could submit a timely and valid claim for a cash benefit through February 9, 2024:• With Proof of Payment, you can receive up to 100% of your full purchase price refunded via the class action settlement, including the sales tax, for as many products as you can provide receipts or evidence of purchase for.
• Without Proof of Purchase, you can receive up to the full retail price for up to 2 products, plus 10% to account for sales tax, on average. This average price will be determined "in good faith" by the Class Action Claims Administrator.
Which Products Are Included in the Class Action?
Broadly, the Lyons Magnus includes drinks such as Oat Milk, Protein Shakes, Coffee Shakes, Cold Brew Coffee, Dairy Milk, Nutritional Drinks, Pediatric Formulas, Thickened Dairy Milk, and coconut flavored Protein Drinks. This includes various flavors of all of the mentioned products. Below is a list of brands that are impacted by this Class Action. Some of the qualifying drinks covered by the class action, such as Glucerna, which produces shakes and other bottled drinks, are sold only at Costco, BJ's Wholesale Club, and Sam's Club.Depending on which lot and "Best By" dates you purchased, your purchase may qualify for a payout from the $3.5 Million Protein Drink, Oat Milk, and Dairy Milk Settlement.
