What Was the TransAm Trucking Lawsuit About?
Drivers alleged that TransAm Trucking and related defendants failed to pay required minimum wages for orientation and driving work and failed to make disclosures required by federal Truth-in-Leasing regulations. The case included federal wage claims, a Florida minimum-wage theory, Kansas wage and consumer-protection allegations, and lease-related claims concerning deductions, insurance, expenses, and escrow funds. Which Claims Were Covered?
The monetary settlement grouped the allegations into three principal categories. The Company Driver Orientation Claim concerned drivers who attended orientation in Rockwall, Texas or Tampa, Florida between October 2020 and March 2021. The Lease Driver Minimum Wage Claim concerned people who personally drove for TransAm under a signed independent-contractor agreement while leasing a truck from ONE Leasing beginning September 29, 2020. The Truth-in-Leasing Claim concerned drivers subject to TransAm independent-contractor agreements with charges or deductions from compensation beginning in February 2017.How Was the $3.75 Million Fund Allocated?
After approved fees, administration, litigation expenses, service-related amounts, and a dispute fund, the agreement reserved at least $2.136 million for participating drivers. The orientation category was allocated $125,000, the lease-driver minimum-wage category $700,000, and the Truth-in-Leasing category $1.311 million. The agreement said money allocated to claiming class members would not revert to the defendants; amounts not claimed were to be redistributed among people who submitted valid claims.How Were Individual Payments Estimated?
For the orientation category, the fund was divided equally among eligible claimants and the notice estimated a minimum payment of $35. For the lease-driver minimum-wage category, the notice estimated at least $8 for each qualifying week since September 29, 2020. For the Truth-in-Leasing category, it estimated at least $8.75 for each qualifying week beginning February 1, 2017. A driver who fit more than one category could have a payment reflecting multiple components. These were historical minimum estimates under the settlement allocation, not a currently available payout offer.What Did a Driver Have to Do?
A driver seeking money had to submit a signed claim and consent form by August 23, 2024. The form asked for identifying information, the driver’s relationship to TransAm, and confirmation of the settlement categories in which the driver participated. The administrator and employer records were used to calculate qualifying weeks and amounts, so the process was not a general receipt-upload reimbursement claim. The deadline has passed and OpenClassActions cannot add a driver to the settlement.What Happened If a Driver Did Nothing?
The consequences differed by claim type. The notice explained that doing nothing meant no monetary payment and released the Truth-in-Leasing claim for people within that class. It did not operate as an opt-in to the federal wage collectives. People who wanted money had to file the required form. A person who timely excluded themselves from the Truth-in-Leasing class received no settlement payment and retained the individual rights described in the notice.What Did Final Approval Change?
The court held the fairness hearing on October 15, 2024 and entered final approval on October 22, 2024. The official schedule then lists November 21, 2024 as the distribution date. That record supports describing the case as approved and distributed on the administrator’s schedule, rather than merely proposed. The website does not provide a later claims-paid report, reissue program, or second-distribution notice, so it would be inaccurate to invent a newer payment event.Why Payment Amounts Could Differ
A payment depended on the approved work history and category allocation, the number of valid claims, and any court-approved deductions or reallocations. The settlement also treated different components according to their underlying wage or non-wage character, which could affect the payment documents sent by the administrator.
