This settlement followed a class action against Rash Curtis & Associates alleging the company called consumers using an autodialer (robocaller) or an artificial or prerecorded voice without prior consent, in violation of the Telephone Consumer Protection Act (TCPA). On May 13, 2019, a jury found in the plaintiffs' favor and determined the defendant made 534,698 calls in violation of the TCPA. The claim deadline was June 7, 2022 and has passed, so this page is now for informational and status purposes only.
The TCPA is the Telephone Consumer Protection Act, a federal law that restricts telemarketing and the use of autodialers, artificial or prerecorded voice messages, and SMS texts without consent.

The settlement covered consumers who fell within one or more of the certified classes — people in the United States who received calls or prerecorded/robocall messages on their cellular or landline phones from June 17, 2012 through April 2, 2019 from Rash Curtis, where the telephone number was obtained through skip tracing (including separate "non-debtor" classes for people for whom Rash Curtis never had a debt-collection account).
The fund reserved to pay qualifying class members — $46,421,474.20 — was distributed pro rata per call, representing a minimum of about $86.82 per call received during the class period, for an average of over $700 per class member. More than 12,000 class members received payments over $1,000, with some qualifying for payments between $5,000 and $40,000. Claimants could choose to be paid by paper check or by a digital payment option.
