What's This Settlement About?

A $267,359,000 settlement has been reached as a result of a lawsuit against Rash Curtis and Associates. So far, $75,600,000, has been recovered. The lawsuit alleges Rash Curtis & Associates called consumers using an autodialer (Robocaller) or an artificial or prerecorded voice without prior consent in violation of the TCPA. On May 13, 2019, the jury found in Plaintiff's favor and found that the Defendant made 534,698 calls in violation of the TCPA.

The TCPA is the Telephone Consumer Protection Act, which is a law that is aimed to restrict telephone telemarketing and automated telephone or mobile equipment The TCPA limits the use of dialing systems, artificial or prerecorded voice messages, SMS text messages, and even fax machines. It also specifies several technical requirements for fax machines, autodialers, and voice messaging systems—principally with provisions requiring identification and contact information of the business or entity using the automation to be contained in the message.

How Do I Qualify?

You qualify if you are a member of one or more of the following classes, or groups that meet certain requirements:

Skip-Trace Class 1: Anyone in the United States who received a call on their cellular telephones from June 17, 2012 through April 2, 2019 from Rash Curtis' DAKCS VIC dialer and/or Global Connect dialer whose cellular telephone was obtained by Rash Curtis through skip tracing.

Skip-Trace Class 2: Anyone in the United States who received a prerecorded message or robocall on their cellular telephones [or] landline phones from June 17, 2012 through April 2, 2019 from Rash Curtis whose telephone number was obtained by Rash Curtis through skip tracing. H Cu

Non-Debtor Class 1: Anyone in the United States who received a call on their cellular telephones from June 17, 2012 through April 2, 2019 from Rash Curtis' DAKCS VIC dialer and/or Global Connect dialer whose telephone number was obtained by Rash Curtis through skip tracing and for whom \Rash Curtis never had a debt-collection account in their name.

Non-Debtor Class 2: Anyone in the United States who received a prerecorded message or robocall on their cellular telephones [or] landline phones from June 17, 2012 through April 2, 2019 from Rash Curtis whose telephone number was obtained by Rash Curtis through skip tracing and for whom Rash Curtis has never had a debt-collection account in their name.

What Can I Get?

The settlement fund that has been reserved to pay off qualifying class action members in the amount of $46,421,474.20 shall be distributed pro rata per call to each eligible class member, representing a minimum of $86.82 per call received during the Class Period, for an average of over $700 per class member. More than 12,000 class members will receive payments in excess of $1,000, with hundreds of class members qualifying to receive between $5,000 to $40,000.
