What Was This Settlement About?

An $8,435,800 class action settlement resolved several lawsuits against Uber. The central issue was whether Uber misclassified its drivers and delivery workers as independent contractors rather than employees.

The lawsuits alleged that, because the drivers and delivery workers should have been classified as employees, certain Uber policies toward California drivers violated California labor law. Specifically, the cases claimed Uber failed to reimburse drivers for vehicle-related and phone expenses and failed to provide accurate, itemized wage statements. Uber denied wrongdoing and agreed to settle to avoid the cost and uncertainty of continued litigation.

Who Was Eligible?

The settlement covered current and former drivers who used the Uber Rides App in California between February 28, 2019 and December 16, 2020, or who used the Uber Eats App between June 28, 2016 and October 7, 2021, and who were not bound by Uber's arbitration clause.

What Did Drivers Receive?

Each driver's payment depended on the miles driven while using the Uber Rides App or Uber Eats App — either to pick up a passenger or item, or while transporting a passenger or item.

Payments also depended on how many drivers filed claims. Assuming a 100% claims rate, and after deductions for attorneys' fees, administration costs, and service awards, the average settlement share was estimated at approximately $4,750 per claiming class member. At a 50% claims rate, that estimate would roughly double to about $9,500.
