What Was the Canadian Yahoo Data Breach Class Action?

Yahoo and Rogers Communications, a large Canadian media company, settled a $20,000,000 class action over a series of data breaches that exposed personal user data. The case concerned data breaches that occurred at Yahoo between 2013 and 2016. Rogers Communications was named due to its partnership with Yahoo in Canada.

The lawsuit alleged that Yahoo had inadequate data security measures in place, leading to unauthorized access to the personal information of Yahoo account holders. The settlement resolved these allegations without any admission of wrongdoing by Yahoo. (A separate $117.5 million U.S. Yahoo data breach settlement resolved related claims for U.S. and Israel residents.)

Who Qualified for a Payout?

You qualified if you were a Canadian resident who had a Yahoo account at any time between January 1, 2012 and December 31, 2016 and did not opt out of the class action.

How Much Could Class Members Get?

The payout depended on the claim category:

Category A Claims: up to $25,000 for documented out-of-pocket costs, paid user costs, and small business user costs.
Category B Claims: up to $125 for each data breach, to a maximum of $375 for lost or wasted time and inconvenience.
Category C Claims: credit monitoring services for up to two years, with an estimated retail value of $478.80.

Was Proof Required to File a Claim?

Proof requirements varied by category:

Category A Claims: required supporting documentation for out-of-pocket costs, paid user costs, and small business user costs.
Category B Claims: required a copy of the breach notice received, or proof of current Canadian residency.
Category C Claims: no additional proof beyond what was needed for Category B, but claimants had to elect credit monitoring on the Alternative Compensation Claim Form.
