What's the Forefront Dermatology Class Action Settlement About?

A $3.75 Million class action lawsuit has been settled with Forefront Dermatology over a massive data breach that may have affected patient data. In 2021, Forefront Dermatology, S.C. and Forefront Management, LLC (collectively referred to as "Forefront") had their information technology network compromised by a sophisticated criminal cyberattack (also known as "Attack" or "Ransomware"), which led to the compromise of certain files belonging to Forefront.

These files may have contained the information of Forefront's patients and other affiliated people. You may want to consider the following information if you are a patient or another individual whose information may have been compromised as a consequence of this incident. If this applies to you, please read on as you may be qualified for up to $10,000 in reimbursement for your troubles.

Forefront Dermatology, as well as Forefront Management, LLC have come to an agreement over the terms of a proposed Open Class Action Settlement after an incident involving ransomware. In May of 2021, hackers made an effort to get unauthorized access to the information that was held on Forefront's information technology network. Because of this, the Personally Identifiable Information (PII) of millions of people who are or were patients, employees, or in some other way linked with Forefront may have been accessed (this is referred to as a "Attack" or a "Ransomware Attack").

The potentially impacted personally identifiable information of patients is as follows:

Forefront Dermatology has stated that the investigation in to the data breach hack only found that a relatively small amount of patients had their data involved in the breach, they could not be certain that the files that contain personally identifiable information of other patients was not subject to access by malicious actors (the data breachers, in this case).

How Do I Know if I Qualify?

You have until February 8, 2023 to complete out a claim form, the link for which is provided below directly to the Forefront Dermatology Class Action administration, and submit it so that you may be considered for a reimbursement.

The Court came to the conclusion that Class Members include anyone who is a resident of the United States, whose personal information may have been compromised as a result of the Ransomware Attack, and who received notification from Forefront, either by email or through the U.S. mail, that their personal information may have been compromised as a result of the Ransomware Attack.

How Much Can I Get Paid?

If you qualify as a member of the Class, you have the right to file a claim for financial compensation based on any one of the following circumstances, or any combination thereof:

A cash payment of up to $10,000 for reimbursement of Documented Losses that are most likely the result of the Forefront Ransomware Attack and are not otherwise recoverable through insurance ("Documented Loss Payment"), and/or a cash payment of up to $125 for reimbursement of Lost Time related to efforts undertaken to prevent or mitigate fraud and identity theft following the Forefront Ransomware Att and/or a cash payment of up to $10,000 for reimbursement of Documented Losses that are more likely than not the result ("Lost Time Payment").

All of these advantages are contingent upon one another, OR they can be substituted for the first three possibilities, which are as follows: a cash fund payment that is proportional to the number of Class Members who opt in to the Settlement and make use of the Credit Monitoring and Insurance Services; lost time payments; and documented loss payments. To phrase it another way, the entire sum of the Cash Fund is: The overall price will be established based on the number of Members of the Class who make use of the services.

All of the aforementioned, as well as the following, will be included in the Credit Monitoring and Insurance Services: Members of the class will receive I identity theft insurance coverage of up to $1,000,000 and (ii) credit monitoring services from each of the three major credit reporting agencies for a period of TWO YEARS. During this time, the class member will be notified of, among other things, any changes that have been made to their credit profile. If you have already enrolled for credit monitoring services via another provider, you have the option to postpone the commencement of the Credit Monitoring and Insurance Services by up to a year at no additional cost to you. You are eligible to choose this alternative if you already receive credit monitoring services from another provider.

Claims made by Class Members have the potential to either enhance or decrease the overall settlement amount (also known as "pro rate" or pro rated). The following provides concise but comprehensive information regarding the Settlement and the advantages it brings, all of which is freely accessible.

What Else Does the Forefront Data Breach Settlement Provide?

The Settlement establishes a $3.75 million Settlement Fund that will be used to pay for Credit Monitoring and Insurance Services, Documented Loss Payments for reimbursement of Documented Losses, Lost Time Payments for efforts undertaken to prevent or mitigate fraud and identity theft related to the Ransomware Attack, or Cash Fund Payments to valid claimants; costs of Notice and administration; Service Awards to the Class Representatives; and attorneys' fees, costs, and expenses. In addition, the Class Representatives will receive Service Awards for their work Additionally, Forefront has consented to carry out a number of corrective steps as well as increased data security procedures.

Forefront Dermatology Settlement Claimants have the option of selecting one or all of the following: credit monitoring and insurance services, documented loss payments, and/or lost time payments; alternatively, claimants may choose to receive a cash fund payment, which will be distributed from the fund in the following order:

• Credit Monitoring and Insurance Services for a period of two years Credit Monitoring and Insurance Services for a period of two years,

• Reimbursement for specific Documented Losses, often known as money spent or lost as a direct consequence of the Forefront Data Breach (up to $10,000), which is money that is not otherwise reimbursable under insurance. Documented Loss Payments,

• Lost Time Payments are a payment for time lost due to actions conducted after the notification of the Ransomware Attack to prevent or mitigate fraud and identity theft (up to $125 per Class Member).

Cash Fund Payments - if you do not make a claim for a Documented Loss Payment, Lost Time Payment, or Credit Monitoring, you may submit a claim for a Cash Fund Payment instead, which will entitle you to a cash payment in an amount that will be determined consistent with the Settlement. The cash payment will be in an amount that will be determined consistent with the Settlement.

There is a possibility that the total amount of all payments will be raised or decreased proportionately depending on the number of Class Members who want to take part in the Settlement.

How Do I File a Claim?

You must submit a claim to qualify for a payout. You can do so by visiting the claims administration website below and filing a claim by February 8, 2023 at 11:59:59 P.M. Pacific Time at the latest. In order to be eligible for benefits, you will need to fill out a Claim Form and submit it by the deadline of February 8, 2023 either online or in the mail with a postmark from that date.
