What's The Hibbett Settlement About?

Hibbett, City Gear and Sports Additions retail stores have agreed to pay out a no proof required settlement as a result of a class action lawsuit. The class action litigation alleged that Hibbett Stores, which also include City Gear and Sports Additions stores, willfully violated FACTA by printing point-of-sale receipts for credit card and debit card transactions that included more than 5 digits of the customer's card number. FACTA is a consumer law designed to protect consumers in three broad ways:

• Security and Privacy
• Credit Reporting

According to Court documents, Hibbett Stores allegedly displayed more than the last five digits of the card number, which would be in violation of FACTA. FACTA, or the Fair and Accurate Credit Transactions Act is an act passed by the US congress in 2003 that aims to improve consumer credit-related activities and protect consumer personally identifiable information.

There are more than 1100 Hibbett stores nationwide. Hibbett, City Gear and Sports Additions physical retail stores are all over the United States, however, of the over 130 City Gear stores, most are concentrated in the central region of the US. Hibbett claims on their website that they have stores in 34 states, and that Hibbett is one of the fastest growing retailers in the country.

How Do I Qualify?

You may be included in the Hibbett FACTA Class Action Settlement if you used a credit or debit card at a Hibbett, a City Gear, or Sports Addition retail store anytime between December 15, 2020 and February 23, 2022. You will need to submit a valid and timely claim form (see below) by the deadline to qualify. The purchase must have resulted in a point-of-sale receipt that included more than 5 digits of your debit or credit card number on the receipt, in violation of FACTA.

The Hibbett FACTA class action administration website will ask you for a notice ID and Hibbett Rewards Account Number. You do not need to have this notice ID or the rewards number for Hibbett Stores in order to file a claim. However, you will be asked to fill out the following information in order to qualify for a payout:

• Information for at least one purchase at a Hibbett, City Gear, or Sports Addition Physical Retail Store
• Store Name
• City Where the Store is Located
• Date of Purchase
• Type of credit or debit card (VISA, MasterCard, American Express, etc.)

What Can I Get in the Hibbett Class Action?

The amount of payment you will get from this class action settlement is stated to be $20 on the Hibbett FACTA class action settlement website. The site states that the reward of $20.00 may be paid into a Hibbett rewards account that either already exists, should you provide it, or one that Hibbett Stores will create for you.
