What's This Settlement About?

A $4,000,000 class action lawsuit has been settled with Lemonade, a popular insrurer that provides consumers with renters, homeowners, and pet health insurance. The class action settlement alleges that Lemonade violated Illinois, New York, California, and other state laws and common law by collecting, capturing, or receiving consumers' personally identifiable information (PII) in the form of biometric data such as their fingerprints, eye retina scans, facial recognition, and so forth.

The court has granted final approval for the lemonade class actions settlement in August of 2022. However, the class action administrator is undergoing calculations and reviews of the submitted class action claims. The class action is closed to new claim form submissions as of April 29, 2023. The Biometric Information Protection Act, known as BIPA is a law enacted by the State of Illinois in 2008 which regulates the collection, use, and handling of biometric identifiers and information by private companies or entities. The BIPA covers "biometric" data, which includes the sort of information companies collect from users in their App with features such as facial recognition, fingerprinting and retinal eyeball scans.

How Do I Qualify?

There are two settlement sub-classes for which consumers can qualify:

Illinois Settlement Class:

All Lemonade policyholders in the State of Illinois who, between June 25, 2019, and May 27, 2021, provided first notice of loss through a video claim submission. If you think that this video may have contained biometric information and Lemonade could have then collected, captured, received, or otherwise obtained or disclosed data or information that could be construed as biometric identifiers of any kind and/or biometric information of any kind.

Nationwide Settlement Class:

All Lemonade policyholders in the United States who, between June 25, 2019, and May 27, 2021, provided a first notice of loss through a video claim submission. If you think that this video may have contained biometric information and Lemonade could have then collected, captured, received, or otherwise obtained or disclosed data or information that could be construed as biometric identifiers of any kind and/or biometric information of any kind.

A Unique ID is required to file an online Claim. If you do not have your Unique ID, you may contact the Settlement Administrator on their website (see link below).

What Can I Get?

A Settlement Fund has been created totaling $4,000,000, of which $3,000,000 will be allocated to members of the Illinois Settlement Sub-Class, and $1,000,000 will be allocated to members of a Nationwide Settlement Class.

In addition to the $4 Million class action settlement fund, Lemonade agree to stop collecting biometric identifiers or biometric information. Within seven days after the entry of the Final Approval Order, Lemonade will delete all previously collected biometric information from all Settlement Class Members.

How Do I File a Claim?

To get your payment you must submit claim form online or by mail no later than August 22, 2022. The hearing to consider the fairness of this class action settlement is scheduled for August 25, 2022.
