What's the Spartan Mosquito Repellent Class Action About?

A $3,600,000 Class Action Settlement has been agreed upon over certain Spartan Mosquito Repellent products. AC2T, the Mississippi-based company that manufactures and markets the bug repellent products, has been accused of fraud and false advertising in the original class action lawsuit. While AC2T agreed to pay $3.6 Million in the settlement, they have not accepted any wrongdoing on their part. However, in order to resolve the class action lawsuit, payments will be made out to qualifying consumers with or without proof of purchase in order to qualify.

How Do I Qualify to Get Paid?

In order to qualify for a payout from the Spartan Mosquito Class Action Settlement you must be in the United States, and you must have purchased one of the included Spartan Mosquito products between the dates of December 21, 2016 and August 2, 2023 for personal use, which include the following repellent or bug spray products:

Spartan Mosquito Eradicator
Spartan Mosquito Pro Tech

The deadline to file a claim is December 1, 2023. The claim form can be either postmarked or filled out online. On December 4, 2023, at 9:00 a.m., the Court will hold a hearing in order to decide on providing approval of the bug spray and repellent class action settlement.

Do I Need Proof of Purchase to File a Claim?

No, proof or documentation of purchase is not required in order to file a claim in the AC2T Spartan Mosquito Repellent Class Action Settlement. There is a monetary cap set for claims that are filed without proof, which may be lower than claims where proof of purchase can be provided. The breakdown of payments is as follows:

No Proof of Purchase: For those claimants that do not have proof of purchase, they can file a claim for up to 5 Spartan Mosquito Repellents or aerosols at $1.75 each for a total of $8.75.

With Proof of Purchase: Those who do provide a valid claim with a proof of purchase can receive $3.00 per claimed Spartan Mosquito Repellent or aerosol.

How Much Will I Get Paid?

The class action is divided into three tiers of claims:

Those who do not have proof of purchase: Tier 1 - $7 per Box purchased, up to one Box (one product) per household.

Those who submit proof of purchase: Tier 2 - may receive $10.00 per qualified product purchased, if there is no direct proof of the original purchase price.

Those who submit proof of purchase and can prove purchase price: Tier 3 - may receive a full refund for all qualified products they can show were purchased.

The payouts will be determined by the total number of valid claims made before the final class action deadline of December 1, 2023. The numbers above are estimated, and may be pro rated. If more claims are filed than expected, the amount will be lower per valid claim product. If the total amount of valid claims filed are less than expected, the payout may be higher than the estimation.
