What's the Spirit Airlines Class Action About?
A $8,500,000 Class Action Settlement has been agreed upon over Spirit Airlines carry-on bag fees. The Spirit Airlines class action lawsuit was filed in August 2017 originally. The lawsuit alleged that consumers had to pay an additional fee to bring their carry-on bags on board Spirit airline planes even after they had already paid for a flight ticket that included carry-on bags for no additional cost. The class action lawsuit alleges that this was a breach of contract that has affected airline travelers, who were baited into more charges after an initial purchase online on websites such as Expedia.
While Spirit Airlines has agreed to pay $8.5 Million in the settlement, the airline has not accepted any wrongdoing on their part. However, in order to resolve the class action lawsuit, payments will be made out to qualifying consumers with or without proof of purchase for payout. The deadline to file a claim is January 10, 2024.
How Do I Qualify to Get Paid?
In order to qualify for a payout from the Spirit Airlines Carry-On Bags Class Action Settlement you must fit the following criteria:
• You must have been a resident of the United States at the time you booked your Spirit Airlines flight;
• You must have booked a flight during the following times: August 31, 2011 and May 3, 2017;
• You must have paid a carry-on bag fee;
• You must have booked a flight onto a Spirit Airlines flight through one of the following Online Travel Agencies: CheapTickets, Travelocity, Bookit, Expedia, Kiwi, or CheapOair;
• The booked ticket must have been your first flight on Spirit after August 1, 2010;
• Depending on the State you are in, the Statute of Limitations (SOL) may affect your ability to recover funds from the Spirit Airlines Open Class Action Settlement. The statute of limitations will impact your claim only if the statute of limitation in your state is less than six years, and you bought your Spirit flight more than the specified number of years before August 31, 2017. Do I Need Proof of Purchase to File a Claim?
No proof of purchase or documentation is required in order to file a claim in the Spirit Airlines Class Action Settlement. However, the Carry-On Bags Class Action administrators may ask for more information at a later point in time after the class action claims period is closed.
How Much Will I Get Paid?
The Spirit Airlines Carry-On Baggage Fee Settlement will pay consumers up to 75% of the additional charge they paid for during the qualifying class action period between August 31, 2011, and May 3, 2017. Based on the historical prices of Spirit Airlines carry-on baggage fees, we are estimating this will be about $25.00 per consumer claim filed.
The payouts will be determined by the total number of valid claims made before the final class action deadline of January 10, 2024. The numbers above are estimated, and depend on the actual cost of purchasing carry-on baggage in addition to your Spirit Airlines flight ticket.
