What's the Wipe Out!® Wipes Class Action About?

A $2 Million Class Action Settlement has been agreed upon over certain Wipe Out!® products, such as wipes, and "decontaminant" or "disinfectant" sprays. Class action claimants can get paid an estimated $6 to $15 per valid claim for those that qualify. Read on below to see what the requirements are for receiving a class action payout.

The Wipe Out!® class action lawsuit alleged that the defendant in the case (Tzumi Innovations) created false advertising via their product labeling, packaging and marketing, which led consumers to inaccurately believe that their spray and wipes products were safe and legal to use as disinfectants for surfaces. The class action lawsuit alleges that these false marketing practices were in direct violation of both state and federal law.

According to the United States Attorney for the Southern District of New York (U.S. Department of Justice), as well as the administrator of the U.S. Environmental Protection Agency (the EPA), Wipe Out!® products were sold illegally to millions of consumers in the United States under the false impression that they were to be used as sanitary disinfectants for surfaces, when in fact the EPA had not found Wipe Out!® wipes and sprays to be safe or effective for consumers. According to these federal law enforcement bureaus, the Federal Insecticide, Fungicide, and Rodenticide Act (“FIFRA”) was violated when Wipe Out! products were sold on the consumer market, on stores such as Lowes.com and Amazon.com.

How Do I Know If I Qualify?

You may qualify if you purchased certain Wipe Out!® products. The purchase must have been made up until and including April 19, 2023 at the latest. The following Wipe Out!® products are included in the class action settlement:

• Wipe Out!® Wipes
• Wipe Out!® Multi-Surface Wipes
• Wipe Out!® Multi-Surface Decontaminant Spray

Do I Need Proof of Purchase to File a Claim?

No, proof or documentation of purchase is not required in order to file a claim in the Wipe Out!® Class Action Settlement. There is a monetary cap set for claims that are filed without proof. If you claim to have purchased more than this limit, your payment will be reduced to the maximum cap for claim forms that do not have any proof of purchase attached.

How Much Will I Get Paid?

The class action is divided into two categories of claims:

• Those who submit proof of purchase: may receive $3.00 per qualified product purchased, up to $15.00 per claim.

• Those who do not have proof of purchase: may be entitled to receive $2.00 per every qualified Wipe Out! product purchased, up to a maximum of $6.00 per claim form.
