You may be part of a new set of class action settlements totaling $555,000 that would resolve claims alleging that certain wastewater disposal wells contributed to induced earthquake damages in Oklahoma, including a magnitude 5.1 earthquake near Prague on February 2, 2024. The Settlements cover earthquake damages that occurred between January 19, 2019 and the Effective Date across Oklahoma.
The Settling Defendants are Spess Oil Company, Circle 9 Resources, and Culbreath Oil & Gas Co., Inc. The Settling Defendants deny wrongdoing. Benefits will be provided only if the Court grants final approval and after any appeals are resolved.
What is the Total Settlement Amount?
The Settlements provide $555,000 in cash to a common fund. Payments go to eligible Settlement Class Members who submit completed Claim Forms with documentation of repair damages. Attorneys’ fees, costs, and incentive awards will be requested from the fund subject to Court approval.
How Do I Qualify For a Payout?
You may qualify if you owned or had an interest in real property within Oklahoma between January 19, 2019 and the Effective Date and that property suffered earthquake damage from Oklahoma seismic events during the period. Standard exclusions apply. If you are unsure, review the notice or contact the Settlement Administrator.
How Much Can I Get Paid?
Payments compensate documented repair damages and follow Zone A and Zone B allocations:
Zone A: Properties in Lincoln, Payne, Logan, Oklahoma, Cleveland, Pottawatomie, Seminole, Okfuskee, and Creek counties. Zone A receives 90% of the net fund, distributed based on approved, documented damages.
Zone B: Properties in all other Oklahoma counties. Zone B receives 10% of the net fund, distributed based on approved, documented damages.
If total approved claims exceed the net fund, payments are reduced pro rata based on each approved claimant’s sum certain. If approved claims are less than the net fund, distribution follows approved sums and any excess is returned to Settling Defendants in proportion to their contributions.
What Documentation Do I Need?
You must submit a completed Claim Form and evidence of earthquake repair damages. Documentation can include contractor estimates, invoices, or repair bills. Claim a sum certain that does not exceed your documented amounts.
How Do I File a Claim?
File online at the official website, by email, or by mail. Read the instructions carefully and submit all required documentation with your Claim Form. Keep copies for your records.
