What's the PC Richard & Son Class Action Settlement?
A nearly $5 million class action lawsuit has been settled with P.C. Richard & Son. The class action lawsuit claimed that P.C. Richard & Son allegedly violated the Fair and Accurate Credit Transactions Act (FACTA) by printing customer credit/debit card expiration dates on receipts.
How Do I Qualify For a Payout?
You must have used a personal American Express (AMEX) credit or debit card at a P.C. Richard & Son store in the United States between November 12, 2015 and August 18, 2016, and received a printed receipt with your card's expiration date.
How Do I Find Class Action Settlements?
Find all the latest Class Action Settlements you can qualify for by getting notified of new lawsuits as soon as they are open to claims:
How Much Can I Get Paid?
As part of the proposed Settlement, P.C. Richard will establish a common fund amounting to $4,900,000, referred to as the “Cash Fund.” If you qualify as a Class member, you may be eligible to receive a payment of up to $1,000.00, depending on the final approval of the Settlement by the class action court.
In addition to cash compensation to qualifying consumers as part of the class action settlement, P.C. Richard & Son has also agreed to implement a new written policy that will prohibit the printing of more than the last five digits of any credit or debit card number, as well as the expiration date, on any printed receipts moving forward.
What is the Total Settlement Amount?
The total settlement fund in this class action lawsuit against P.C. Richard & Son, is $4,900,000.
This amount will be used to:
• Pay eligible class members
• Cover any attorneys' fees and expenses
• Provide an incentive (service) award to the Class Representative
• Cover administration costs, including notice and other expenses
After these deductions, the remaining amount, called the "Net Cash Fund," will be divided among all eligible class action members who file a valid claim form on time. Each eligible member may receive a pro-rata share, estimated at up to $1,000.
How Do I File a Claim?
You may have already received a notice in the mail or email, although a notice is not required to file a claim form. If you have received written notice with a Claim Number that starts with the letter "A," you are recognized as an Eligible Settlement Class Member. In this case, you do not need to take any further action to receive your payment, which could be as much as $1,000.00, provided the Settlement is finalized.
If you received a Notice Number beginning with the letter "P," this indicates that your records show you made transactions at P.C. Richard using an AmEx card. However, it is unclear if the card was a personal or business card. To receive a payment, you must submit a Short-Form Claim Form confirming that at least one transaction was made with your personal AmEx card.
For those who did not receive any written notice, you must complete and submit a Claim Form-R to become an Eligible Settlement Class Member and potentially receive up to $1,000.00.
Do I Need Proof to File a Claim?
Yes, you will need to provide proof of your transaction. If you are submitting a Claim Form-R, you have two options for providing proof:
Option (1): Attach an original or a copy of your customer receipt that includes the expiration date of your AmEx card and demonstrates that you made a transaction at any P.C. Richard store during the specified period.
Option (2): Attach an original or a copy of your AmEx credit or debit card statement that shows a transaction at any P.C. Richard store during the same timeframe. It is essential to redact sensitive information from your statement, such as account numbers and other purchases, ensuring that only your name, address, and transaction details are visible.
Regardless of the number of eligible transactions, you may only submit one claim. If you choose to send an original document, it is advisable to keep a copy for your records, as the settlement administrators will not be liable for any lost original documents.
If you need to mail your Claim Form-R, ensure it is postmarked by November 26, 2024. You may also submit your claim electronically by the same deadline mentioned before.
