What is the HelloFresh automatic renewal settlement about?

You may be part of a new $7.5 million settlement reached with Grocery Delivery E Services USA Inc., which does business as HelloFresh, over allegations that its automatic renewal subscription program for meal kits violated California consumer protection laws.

Class action lawsuit prosecutors in several California counties accused HelloFresh of enrolling customers in automatically renewing meal kit plans without clearly disclosing key terms, charging customers for deliveries they did not knowingly authorize, and making it too hard to cancel.

The company denies any wrongdoing. Rather than continue litigating over its automatic renewal and subscription practices, HelloFresh agreed to a Final Judgment and Injunction that includes changes to how it markets subscriptions and a $7.5 million monetary payment, including a $1 million Restitution Fund for eligible California customers.

What is the Total Settlement Amount?

The class action settlement orders HelloFresh to pay a total of $7,500,000.

Of that total settlement amount, $6,380,000 is alloted to civil penalties payable to several California prosecutors and city attorneys, $120,000 is allocated to investigative costs, and $1,000,000 is set aside in a Restitution Fund that will be used to refund eligible California HelloFresh customers who were harmed by the automatic renewal practices at issue.

How do I qualify for a payout?

You may qualify for a payment from the Restitution Fund if you meet all of the following conditions as a California customer:

• You were enrolled in a HelloFresh Automatic Renewal Product Subscription any time between January 1, 2019 and August 18, 2025.
• You were charged for the first shipment of your HelloFresh subscription without your knowledge or consent.
• You cancelled your HelloFresh Automatic Renewal Product Subscription after that first shipment.
• You never received a refund of the charges for that shipment.

Only California consumers who meet all of these conditions are considered “Eligible Recipients” under the Final Judgment. If you already received a full refund for those charges, you will not be eligible even if you otherwise meet the criteria.

How much can I get paid?

Under the Restitution Program, each Eligible Recipient on the Final List of Payees is supposed to receive a complete refund of all amounts they paid to HelloFresh before the Effective Date of the Judgment and that qualify under the settlement criteria.

The total cash restitution cannot exceed the $1,000,000 in the Restitution Fund. If the total value of valid claims is more than the amount in the fund, payments will be reduced on a pro rata basis so that all Eligible Recipients share the Restitution Fund proportionally.

In simple terms, if relatively few people file claims, each refund is more likely to reflect the full amount paid. If a large number of eligible California subscribers file claims, individual payments may be reduced so that everyone shares the same limited pool.

How do I file a claim?

To receive a payment you must submit a Claim Form. There is no automatic refund just because you had a HelloFresh account.

You can submit a claim online by visiting the official Grocery Delivery E Services USA Inc. Restitution Program website, which is linked from the OpenClassActions.com coverage of this case.

If you prefer to file by mail or do not have easy online access, you can download and print a paper Claim Form from the official site or request one by phone. After filling it out, you mail it to the address listed on the form.

The Claim Form will ask for:

• Your name and mailing address so a check can be sent to you.
• The email address and phone number you used for your HelloFresh subscription.
• A statement under penalty of perjury that you are a California consumer who was enrolled in a HelloFresh Automatic Renewal Product Subscription between January 1, 2019 and August 18, 2025, were charged for the first shipment without your knowledge or consent, cancelled after the first box, and never received a refund for those charges.

All Claim Forms are reviewed by the official HelloFresh class action settlement claims administrator for completeness and plausibility. Please note that typically, incomplete or inconsistent claims can be rejected or may need correction before they qualify.

What if I cannot file online?

If you do not have a Claim Form link or cannot file online, you can still participate. You can:

• Download and print a Claim Form from the Restitution Program website and mail it in, or request that a paper Claim Form be mailed to you.
• Complete every section of the form and sign it. By signing, you are swearing under penalty of perjury that everything in the form is true and accurate and that you meet all of the eligibility criteria described above.
• Mail the completed form so that it is postmarked no later than December 17, 2025 postmarked or, preferably received by that date.

What is the Claim Form Deadline?

The deadline to submit a valid Claim Form is Wednesday, December 17, 2025.

Online Claim Forms must be submitted through the official website by that date. Paper Claim Forms must be postmarked no later than December 17, 2025. Claims submitted after the deadline are likely to be rejected.

Is proof required to file a claim?

The program does not require you to upload receipts or bank statements in most cases. You are not asked to attach detailed purchase proof when you submit your Claim Form.

However, you must provide enough information for the Claims Administrator to match you to HelloFresh subscription records, and you must sign a sworn statement under penalty of perjury that:

• You are or were a California consumer who signed up for a HelloFresh automatic renewal subscription without your knowledge or consent any time between January 1, 2019 and August 18, 2025.
• You cancelled your automatic renewal subscription after the first shipment.
• You have not already received a refund for all of the money you paid for that subscription.

Claims that are incomplete, inconsistent with HelloFresh records, or not credible may be denied. Providing false information can lead to rejection and may carry legal consequences.

How many people are affected?

The HelloFresh class action does not list a specific number of affected customers. Instead it defines a broad group of California consumers who were enrolled in HelloFresh automatic renewal subscriptions that met the criteria above.

HelloFresh has had a large subscriber base across the United States, and only a subset of those customers qualify. How many people will ultimately receive payments depends on how many Eligible Recipients file valid claims by the deadline.

What are the important dates?

Here are the key dates to know for this settlement:

Class period for eligibility: January 1, 2019 through August 18, 2025. You must have been enrolled in a HelloFresh Automatic Renewal Product Subscription during this period to be considered.

Final Judgment date: The Santa Clara County Superior Court entered the Final Judgment and Injunction in August 2025.

Restitution Fund deposit: HelloFresh must fund the Restitution Fund and administration costs shortly after the Effective Date of the Judgment.

Claim deadline: December 17, 2025.

What Is HelloFresh and How Big Is It Now?

HelloFresh is one of the largest meal kit subscription companies in the world. At its peak in late 2021 it reported around 7.22 million active customers, and it still serves over 7 million customers worldwide as of 2024, across more than a dozen countries including the United States, Canada, the U.K., and Germany.

HelloFresh has also been in the news for food safety issues and subscription practices. In 2025 U.S. regulators issued a public health alert over possible Listeria contamination in certain ready-to-eat HelloFresh meals, and California prosecutors brought this automatic renewal case over how HelloFresh marketed and billed its subscription plans. For people who only know the brand from influencer ads or YouTube sponsorships, these enforcement actions show how big subscription food companies can face serious scrutiny over both how they sell and what they ship.

When is the settlement payment date?

There is no single fixed “payment date” listed in the public documents. Instead, the Final Judgment gives a timeline:

The Claims Administrator collects claims after the Effective Date of the Judgment and the December 17, 2025 deadline.

The Administrator then prepares a Preliminary and Final List of Payees, calculates how much each Eligible Recipient should receive, and reports the total amount of restitution to the parties.

Once that process is complete, the Administrator begins mailing checks. Those checks will expire if they are not cashed within the time stated in the program materials, so it is important to keep your address up to date.

In practice, that means payments will go out sometime after the claims review and calculation stages are finished, not on the same day as the claim deadline.

What changes did HelloFresh agree to make?

Besides paying money, HelloFresh agreed to an injunction that targets its automatic renewal and subscription practices in California. Among other things, the company is now required to:

Clearly and conspicuously disclose automatic renewal offer terms, including how much will be charged, how often, and how to cancel, before taking payment.

Obtain express affirmative consent from California customers to those automatic renewal terms, such as through a clearly labeled checkbox or consent button that appears next to the full terms.

Send confirmation emails that clearly identify the transaction as an automatic renewal or continuous service subscription and explain how to cancel.

Provide advance notices for certain long trial or discounted offers and for subscriptions with an initial term of at least one year, so customers are reminded that renewal is coming.

Offer easy, cost effective cancellation methods, including a simple online option that allows California consumers to cancel without jumping through extra hoops or dealing with “dark patterns” that delay cancellation.

These changes are designed to bring HelloFresh into compliance with California’s Automatic Renewal Law and other consumer protection statutes, and to reduce the risk of surprise charges for future subscribers.

Case information

This enforcement action is titled People of the State of California v. Grocery Delivery E Services USA Inc., dba HelloFresh, Case No. 25CV472270, in the Superior Court of the State of California, County of Santa Clara.
