What is This Lawsuit About?

In January 2025, New York Blood Center and Memorial Blood Centers experienced a targeted cyberattack on their computer systems. Hackers accessed files containing sensitive personal information belonging to blood donors and other individuals in the organizations' records.

The data potentially exposed includes:

Full names
Dates of birth
Gender
Social Security numbers
Blood type
Certain blood test results
Financial information (for direct deposit)
Other sensitive personal information

The lawsuit, Dean, et al. v. New York Blood Center, Inc., et al., was filed in Ramsey County District Court, Minnesota. The plaintiffs allege that the Blood Centers failed to adequately protect private information from the cyberattack. The Court has not decided who is right — both sides agreed to settle to avoid the costs and uncertainties of trial.

What is the Total Settlement Amount?

The total settlement fund is $500,000. After court-approved attorneys' fees (up to $166,666.66), litigation costs (up to $2,000), service awards for the three named plaintiffs ($2,500 each), and administration expenses, the remaining money goes to class member claims.

If there is not enough money to pay all claims in full, payments will be reduced pro rata. If fewer people claim than expected, payments may be increased pro rata.

How Do I Qualify For a Payout?

You may qualify if you are a U.S. resident who was sent notice that your private information was compromised in the January 2025 data incident at New York Blood Center or Memorial Blood Centers.

The simplest way to check: if you received a data breach notification letter from the Blood Centers, you are likely a class member.

You can confirm your eligibility at www.BloodCentersSettlement.com or by calling (833) 417-4928 (toll-free, 24/7).

How Much Can I Get Paid?

You can choose one of two cash payment options, plus all class members get free medical data monitoring:

Option A: Documented Losses (up to $2,500)
If you lost money because of identity theft or fraud related to the data breach, you can claim reimbursement for up to $2,500. You must show that the loss was likely caused by the breach and that you attempted to prevent or recover the loss. Losses must have occurred between January 26, 2025 and February 11, 2026. You'll need to provide documentation like receipts — self-created notes alone are not enough.

Option B: Alternate Cash Payment ($20 — no proof needed)
Don't have documentation? You can claim a flat $20 cash payment with no receipts or proof of losses required. This amount may increase or decrease depending on how many people file claims.

Free Medical Data Monitoring (all class members)
Regardless of which cash option you choose, all class members can enroll in 1 year of CyEx Medical Shield Pro at no cost. This comprehensive service includes:

$1 million in medical identity theft insurance
• Monitoring for healthcare insurance ID exposure
• Monitoring for Medical Record Number (MRN) exposure
• Monitoring for unauthorized Health Savings Account (HSA) spending
• Access to a fraud resolution agent if suspicious activity is detected

What is the Claim Form Deadline?

The deadline to submit a claim is February 11, 2026. Online claims must be submitted by 11:59 PM Central Time. Mailed claims must be postmarked by February 11, 2026.

What Are the Important Dates?

• Opt-Out Deadline: January 12, 2026 (passed)
• Objection Deadline: January 12, 2026 (passed)
• Final Approval Hearing: February 10, 2026 at 9:00 AM CT (Ramsey County District Court, Minnesota)
• Claim Form Deadline: February 11, 2026 by 11:59 PM CT

When is the class action settlement payment date?

A specific payment date is not listed in the notice.

In general, settlement payments will be distributed after:

• The Court grants final approval (hearing scheduled for February 10, 2026),
• Any appeals are resolved, and
• Claims are reviewed and processed by the Settlement Administrator.

This process may take several months. If appeals are filed, payments could be delayed further.

Is Proof Required to File a Claim?

For the $20 alternate cash payment (Option B): No. No documentation is needed. You simply submit the claim form and confirm your eligibility.

For documented losses up to $2,500 (Option A): Yes. You must provide proof such as receipts, bank statements, or invoices showing expenses related to the data breach. Self-created notes or explanations can support your claim but are not sufficient on their own. You cannot claim reimbursement for expenses already covered by a third party.

What Information Was Exposed in the Data Breach?

The January 2025 cyberattack on the Blood Centers' computer systems potentially exposed highly sensitive personal information:

• Full names
• Dates of birth
• Gender
• Social Security numbers (SSN)
• Blood type
• Certain blood test results
• Financial information for direct deposit
• Other sensitive personal information

This type of data — especially Social Security numbers combined with medical information — is particularly valuable to identity thieves and can be used for medical identity fraud, where criminals use your information to obtain healthcare services, prescription drugs, or file false insurance claims in your name.

What is Medical Identity Theft?

Medical identity theft occurs when someone uses your personal information to obtain medical care, prescription drugs, or file false insurance claims. It is especially dangerous because:

False medical records can be created in your name with someone else's blood type, allergies, or conditions — which could be life-threatening if you receive emergency care based on incorrect records
Your health insurance can be billed for services you never received, potentially affecting your coverage limits and future insurability
It's harder to detect than financial identity theft because most people don't regularly monitor their medical records the way they check bank statements

This is why the settlement includes medical data monitoring through CyEx Medical Shield Pro — specifically designed to catch medical identity fraud.
