You may be part of a new $2,450,000 class action settlement reached with Panda Restaurant Group, Inc. over allegations that a March 2023 data breach exposed sensitive personal information — including full names, dates of birth, and Social Security numbers — after an unauthorized third party gained access to the company's files.
Panda Restaurant Group denies any wrongdoing, and the settlement still requires final Court approval.
What is the Panda Express Data Breach Class Action Settlement About?
According to the official notice, the lawsuit claims that Panda Restaurant Group failed to adequately protect personal information of individuals affected by a data security incident that occurred in or around March 2023.
The plaintiffs allege claims including negligence, breach of implied contract, unjust enrichment, breach of the implied covenant of good faith and fair dealing, breach of fiduciary duty, and declaratory judgment and injunctive relief.
The case is Halliday, et al. v. Panda Restaurant Group, Inc., No. 24STCV12667, pending in the Superior Court of California, County of Los Angeles.
The Court has not decided who is right as part of the settlement process. The parties agreed to a settlement to avoid the cost and risk of a trial and related appeals.
What is the Total Settlement Amount?
The total settlement fund is $2,450,000. This is a non-reversionary fund, meaning the money is set aside specifically to pay class members and will not revert back to Panda Restaurant Group. The fund will cover cash payments to eligible class members, credit monitoring costs, settlement administration expenses (estimated at $225,381), court-approved attorneys' fees and expenses, and service awards to the class representatives.
You may qualify if you reside in the United States and your personal information was accessed or potentially accessed in connection with the March 2023 data security incident. Specifically, you must have received a Notice of Data Breach letter from Panda Restaurant Group regarding the incident.
Excluded from the settlement class are employees, directors, officers, and agents of the defendant, governmental entities, the assigned judge and court staff, and anyone who submits a valid request to be excluded.
If you are unsure whether you qualify, you can call 1-866-302-7373 or visit the official settlement website.
How Much Can I Get Paid?
Eligible class members can receive multiple types of benefits under this settlement:
Documented Loss Payment (up to $5,000): Reimbursement for actual, documented, unreimbursed out-of-pocket expenses resulting from the data breach incurred on or after March 7, 2024. This can include costs for credit monitoring services, unauthorized charges, late fees, overdraft fees, card replacement fees, transportation costs to deal with fraud, credit freeze costs, phone charges, postage, and other expenses reasonably attributable to the breach.
Pro Rata Cash Payment ($100): A flat cash payment estimated at $100, available to all eligible class members. This amount may be adjusted up or down depending on how many claims are filed.
California Statutory Cash Payment ($125): If you are a California resident, you may receive an additional payment estimated at $125. This amount may also be adjusted pro rata.
Credit Monitoring (2 years): Separately from the cash payments, eligible class members may elect two years of credit monitoring at the defendant's expense. This includes real-time monitoring by all three credit bureaus, dark web scanning with immediate notifications, public records monitoring, identity theft insurance, and access to fraud resolution agents.
