What is the Panera Data Security Settlement About?

If you previously received a notice from Panera about a security incident that Panera discovered on March 23, 2024, you may be owed money. According to the lawsuit, an unauthorized third party accessed certain information that may have included names and Social Security numbers of current and former employees, and a small number of customers, contractors, and other individuals. Panera denies wrongdoing and liability but has agreed to a class settlement that provides cash benefits to eligible Settlement Class Members.

What is the Total Settlement Amount?

The proposed non-reversionary Settlement Fund is $2,500,000. Payments for approved claims, notice and administration costs, any Court-approved attorneys' fees and expenses, and any service awards to the Representative Plaintiffs will be paid from this fund. If total approved claims exceed the fund after these deductions, individual payments may be reduced pro rata.

How Do I Qualify for a Payout?

You may qualify if you reside in the United States and previously received a notice from Panera stating that your Private Information may have been compromised in the March 2024 incident. Some categories require documentation. Exclusions include court personnel on this case, certain Panera officers and shareholders, valid opt-outs, and anyone criminally responsible for initiating or aiding the incident.

How Much Can I Get Paid?

Settlement benefits you can choose include:

Ordinary Out-of-Pocket Losses up to $500 for unreimbursed costs reasonably traceable to the incident such as credit monitoring, credit report freezes or thaws, and related fees. Documentation is required.

Extraordinary Losses up to $6,500 for unreimbursed identity theft or fraud, falsified tax returns, or other misuse fairly traceable to the incident. Requires documentation. You may also claim up to $250 for up to 10 hours of attested time spent remedying issues at $25 per hour when claiming Extraordinary Losses.

California Statutory Payment up to $100 for Settlement Class Members who resided in California at the time of the incident in March 2024.

Residual Cash Payment up to $250 if funds remain after paying approved claims, administration costs, any service awards, and any attorneys' fees and expenses. Amount depends on the number of valid claims and remaining funds.

Is Proof Required to File a Claim?

Documentation is required for Ordinary Out of Pocket and Extraordinary Loss claims. California Statutory Payment and Residual Cash Payment do not typically require receipts, but you must attest to eligibility and may be asked for additional information. You may also be required to provide a notice ID you received, which can be found on the notice you received or by contacting the administrator directly.
