What's the Right Guard Antiperspirant Wipes Class Action About?
A $1,950,000 Class Action Settlement has been agreed upon over certain Right Guard Antiperspirant products. The Right Guard class action lawsuit made allegations that Right Guard aerosol and spray antiperspirant either contained, or were at risk of containing benzene.
There have been previous class action lawsuits, as well as FTC recalls related to consumer products that may have contained benzene. Most recently, Virgin Scent hand sanitizer agreed to a settlement over a class action lawsuit that alleged its hand sanitizer products contained dangerous levels of benzene.
Brut and Sure deodorant settled a class action whose claim period ended in early 2023. In that class action lawsuit it was contended that by not advertising certain Brut and Sure deodorants as containing an ingredient called benzene the defendants were practicing deceptive marketing and false advertising. Coppertone sunscreen settled a $2.3 Million class action lawsuit over benzene, which paid out $60 to consumers, as well as a recall by the FTC that removed certain Coppertone sprays and sunscreens from store shelves in the United States.
In another prime example of benzene in popular consumer products, P&G products such as aerosols, body sprays, and shampoos were recalled due to high levels of benzene contamination. What is Benzene?
Benzene, which is at the center of the Brut and Sure Class Action Settlement, is a well known odorless, and colorless chemical. Prolonged exposure to benzene carries serious health risks and consequences. Thus, the CDC and FDA recommend that consumers be aware of ingesting or consuming benzene in products, as well as the environment. How Do I Qualify to Get Paid?
In order to qualify for a payout from the Right Guard Class Action Settlement you must be in the United States, and you must have purchased one of the included Right Guard products between the dates of November 19, 2018 and June 8, 2023 for personal use, which include the following spray or antiperspirant product:
• Right Guard Sport Antiperspirant Aerosol and Spray product
• Right Guard Xtreme Antiperspirant Aerosol and Spray product
The deadline to file a claim is October 14, 2023. The claim form can be either postmarked or filled out online.
Do I Need Proof of Purchase to File a Claim?
No, proof or documentation of purchase is not required in order to file a claim in the Right Guard Antiperspirant Class Action Settlement. There is a monetary cap set for claims that are filed without proof, which may be lower than claims where proof of purchase can be provided. The breakdown of payments is as follows:
• No Proof of Purchase: For those claimants that do not have proof of purchase, they can file a claim for up to 5 Right Guard antiperspirant sprays or aerosols at $1.75 each for a total of $8.75.
• With Proof of Purchase: Those who do provide a valid claim with a proof of purchase can receive $3.00 per claimed Right Guard antiperspirant spray or aerosol.
How Much Will I Get Paid?
The class action is divided into two categories of claims:
• Those who submit proof of purchase: may receive $3.00 per qualified product purchased, up to $15.00 per claim.
• Those who do not have proof of purchase: may be entitled to receive $2.00 per every qualified Wipe Out! product purchased, up to a maximum of $6.00 per claim form.
The payouts will be determined by the total number of valid claims made before the final class action deadline of October 14, 2023. The numbers above are estimated, and may be pro rated. If more claims are filed than expected, the amount will be lower per valid claim product. If the total amount of valid claims filed are less than expected, the payout may be higher than the estimation.
