Current Status

Claims are closed. The deadline was February 17, 2026. The final approval hearing was scheduled for April 21, 2026, but the official settlement website does not post a final approval order or payment date.

What Happened?

The breach was what's known as an email account compromise. An unauthorized person (or people) gained access to an email account belonging to Summit National Bank. That email account contained files or messages with customers' personally identifiable information — the kind of information that identity thieves need to open credit cards, take out loans, or drain bank accounts in your name.

The data that was exposed included names, home addresses, Social Security numbers, and financial account information. This is about as sensitive as personal data gets. Your Social Security number is essentially the master key to your financial identity, and once it's been exposed in a data breach, it's out there permanently.

The lawsuit alleges that Summit National Bank failed to put reasonable security measures in place to protect this information. Summit denies any wrongdoing. The two sides agreed to settle rather than go to trial.

Who Qualifies?

You qualify if Summit National Bank sent you a notification letter informing you that your information may have been compromised in the May 2024 data breach. The settlement class includes approximately 10,912 people. If you received that letter, you're in.

What Can You Get?

This settlement has three types of compensation, and you can claim all three at the same time:

Up to $5,000 for out-of-pocket losses. If the breach actually cost you money — for example, if someone used your stolen information to commit fraud, or if you had to pay for credit monitoring, credit freezes, a lawyer, an accountant, or credit repair services — you can be reimbursed for those expenses up to $5,000. You'll need documentation like receipts, bank statements, or bills to support your claim. Handwritten notes alone aren't enough, but they can be submitted alongside other records.

Eligible expenses include unreimbursed fraud or identity theft losses, attorney or accountant fees, credit repair services, costs of freezing or unfreezing your credit, credit monitoring costs you paid for after May 2024, and miscellaneous costs like notary fees, postage, copying, mileage, and long-distance phone charges.

Approximately $175 cash payment. This is available to every class member, regardless of whether you suffered any losses. You don't need to prove that anything bad happened to you — you just need to file the claim form. The $175 estimate is based on a 10% claim rate among the 10,912 class members. If fewer people file, the amount goes up. If more people file, it goes down.

Three years of credit monitoring. You can sign up for three years of three-bureau credit and identity theft monitoring at no cost. This covers all three major credit bureaus (Equifax, Experian, and TransUnion) and will alert you if someone tries to use your information to open new accounts.

How Claims Were Filed

During the claim period, class members could file online at SNBDataSettlement.com using the Unique ID printed on their settlement notice.

Paper claim forms were also available by mail.

The February 17, 2026 deadline has passed.

Settlement Fund and Legal Fees

The total settlement fund is $400,000. This is the maximum amount Summit National Bank will pay. Everything comes out of this fund: your payments, the credit monitoring, attorneys' fees, administration costs, and the service award.

Class Counsel (Markovits, Stock & DeMarco, LLC and Milberg Coleman Bryson Phillips Grossman, PLLC) will seek no more than one-third of the fund ($133,333.33) in attorneys' fees, plus up to $15,000 in litigation costs. A service award of up to $4,000 is being requested for the class representative, Brian Purnell.

How Will I Get Paid?

The official settlement website has not announced a distribution date. Settlement payments generally cannot be distributed until any required approval and appeal process is complete.

What Happens If I Do Nothing?

Class members who did not submit a claim by the deadline will not receive a settlement payment or credit monitoring. Their released claims are governed by the settlement terms.
