If you received a notice that your private information may have been exposed in the February 7, 2024 SouthState Bank data incident, you can file a claim for cash and receive free credit monitoring. The claim deadline is June 15, 2026.

A proposed $1.5 million class action settlement has been reached. Class members can choose Cash Payment A (up to $3,500 for documented losses), Cash Payment B (a pro rata cash payment with no proof required), or both. Separately, all class members who do not opt out automatically receive one year of one-bureau credit monitoring with $1,000,000 in identity theft insurance — no claim form required for the credit monitoring benefit.

What Happened?

SouthState Bank, N.A. is a national bank headquartered in Florida. According to the settlement notice, on February 7, 2024, a third party unlawfully accessed SouthState Bank's computer network and accessed the private information of current and former customers. This information may have included names, dates of birth, addresses, telephone numbers, financial account numbers, and Social Security numbers. SouthState Bank began notifying potentially impacted individuals on March 29, 2024.

The lawsuit alleges SouthState Bank failed to implement proper cybersecurity protocols to protect sensitive customer data. Multiple lawsuits were consolidated into the current Action, which brings claims for negligence, breach of contract, breach of fiduciary duty, and unjust enrichment. SouthState Bank denies all wrongdoing, and no court has made any determination of fault. The two sides agreed to settle to avoid the cost and risk of continued litigation.

Who Qualifies?

The Settlement Class includes all living persons residing in the United States who were sent notice that their private information may have been impacted in the Data Incident on or around February 7, 2024. Directors, officers, and agents of SouthState Bank, governmental entities, the assigned Judge and that Judge's immediate family and Court staff, and anyone who timely opts out are excluded.

What Can You Get?

The settlement provides two cash benefits plus an automatic credit monitoring benefit.

Cash Payment A — Up to $3,500 for documented losses. If the breach cost you money — through fraud or identity theft more likely than not caused by the Data Incident and incurred after February 7, 2024 — you can claim reimbursement up to $3,500. Qualifying losses listed in the notice include: bank fees, overdraft charges, late fees, or declined payment fees resulting from fraud; credit monitoring or identity theft protection you purchased in response to the incident; costs to place or remove a credit freeze; professional fees paid to address identity fraud (accountants, attorneys, fraud specialists); replacement costs for government-issued identification; long-distance phone, postage, notary, or similar incidental costs; and fraudulent, unreimbursed charges directly traceable to misuse of data from the incident. You cannot be reimbursed for losses that have already been reimbursed from another source.

Cash Payment B — Pro rata cash payment, no proof needed. All class members can also file for a pro rata (proportional) cash payment with no documentation required. The exact amount is calculated based on how many valid claims are filed and how much is left in the Cash Fund after Cash Payment A claims are paid.

Credit Monitoring — automatic, no claim form required. All settlement class members who do not opt out automatically receive one year of credit monitoring with one credit bureau and $1,000,000 in identity theft insurance. The notice from SouthState Bank included a unique activation code (mailed or emailed). After final approval, class members can activate the code through the settlement website. If you do not know your code, contact the settlement administrator through the official website. SouthState Bank pays for the credit monitoring benefit separately from the $1.5 million Cash Fund.

Order of payment: Cash Payment A documented-loss claims are paid first from the Cash Fund. The remaining balance is then divided pro rata among Cash Payment B claimants. You only need to submit one Claim Form, selecting one or both Cash Payments.

What Proof Do I Need?

For Cash Payment A (up to $3,500): "Reasonable Documentation" generated by a third party — such as credit card statements, bank statements, invoices, telephone records, or receipts. Personal certifications, declarations, or affidavits alone are not sufficient, but can accompany third-party documentation for context.

For Cash Payment B (pro rata cash): no proof needed — just submit the Claim Form selecting this benefit.

For Credit Monitoring: no claim form and no proof needed — the benefit is automatic. Activate your unique code through the settlement website after final approval.

Attorneys' Fees and Service Awards

Class Counsel will ask the Court to approve Attorneys' Fees and Costs of up to $1,750,000, and $1,500 in Service Awards for the Class Representatives. These amounts will be paid by SouthState Bank separately from the Cash Fund and Credit Monitoring costs — they do not reduce the money available to class members.

What Happens If I Do Nothing?

If you do nothing, you will not receive a Cash Payment from this Settlement and will give up your right to sue, continue to sue, or be part of another lawsuit against SouthState Bank about the claims resolved by this Settlement. You will remain a Settlement Class Member and will still be able to activate your Credit Monitoring code to receive the one-year credit monitoring benefit.
