What Is the Google Device Privacy Lawsuit About?

The case is known as In re Google Assistant Privacy Litigation and it alleges Google Assistant recorded private conversations when it was not intentionally activated.

Plaintiffs describe these alleged accidental activations as “False Accepts,” meaning the device detected a hot word even though no hot word was actually spoken.

The lawsuit also claims certain recordings were reviewed and disclosed to third-party vendors as part of Google Assistant’s development and quality processes. Google denies wrongdoing and says it acted lawfully.

What Is the Total Settlement Amount?

A proposed $68 million settlement has been filed to resolve the case.

If approved by the Court, the settlement fund would be used to pay eligible class members who submit valid claims, plus Court-approved attorneys’ fees, litigation expenses, settlement administration costs, and service awards.

A hearing on preliminary approval of the proposed settlement is scheduled for:

March 19, 2026 at 9:00 AM Pacific Time

This is a key step that must happen before a claim form deadline and payment details can be finalized.

Who May Be Included?

The proposed settlement describes two groups that may qualify.

1) Purchaser Settlement Class
This group generally includes people in the United States or its territories whose Google accounts were associated with a Google Assistant enabled device and who purchased a Google-made device during the settlement class period (beginning May 18, 2016 and running through the date the Court grants preliminary approval).

Examples of “Google-made devices” referenced in the settlement include certain Google smart speakers, smart displays, and Pixel phones.

2) Privacy Settlement Class
This group generally includes users of Google Assistant and members of their households during the settlement class period whose communications were recorded or otherwise obtained due to alleged false accepts, and or whose communications were recorded or otherwise obtained and disclosed to third-party review vendors.

How Much Can I Get Paid?

Final payment amounts are not yet set because they depend on Court approval and how many valid claims are submitted.

However, the proposed plan of allocation is point-based:

Purchaser Settlement Class claims are expected to receive more points than Privacy Settlement Class claims, and payments would be calculated proportionally based on the total points submitted in approved claims.

What Proof May Be Required?

The proposed settlement indicates proof requirements may depend on the type of claim:

Purchaser Settlement Class: Proof of purchase is expected to be required (for example, a receipt or order confirmation) along with device information such as device type and serial number.

Privacy Settlement Class: Proof of purchase may not be required, but the claim is expected to require device type and model information and a signed attestation under penalty of perjury.
