FitOn, Inc., the maker of the popular FitOn fitness and workout-video app, has agreed to a $2,500,000 class action settlement to resolve claims that it disclosed subscribers' personally identifiable information — specifically, information tying a person to the videos they watched — to third parties without consent. The lawsuit alleges this violated the federal Video Privacy Protection Act (VPPA), a 1988 law that limits how companies can share what videos a person requests or watches. FitOn denies that it violated any law.
The case is Ava Hoffman et al. v. FitOn, Inc., Index No. 542301/2025, in the Supreme Court of the State of New York, County of Kings, before the Hon. Saul Stein. The two sides agreed to settle to avoid the uncertainty and expense of continued litigation. Who Qualifies?
The settlement class includes all persons in the United States who, from October 22, 2022 through May 29, 2026, had a FitOn account and accessed a FitOn video platform in the U.S. and watched or acquired a pre-recorded video available on the platform. If you received an email notice about this settlement, you have been identified as a class member.
You do not need to have received a notice to be eligible — if you meet the class definition, you can file. The claim form simply asks you to confirm, under penalty of perjury, that you had a FitOn account and watched a pre-recorded video during the class period.
How Much Can You Get?
Each valid claim is for a $10 cash payment. Because the payments come out of a fixed fund, the amount is subject to pro-rata (equal) reduction if the approved cash claims exceed the net settlement benefit cap of $2,500,000 — so the actual amount can be lower depending on how many people file. You choose your payment method on the claim form: a mailed check by default, or PayPal or Venmo if you file online. Note that settlement checks expire and become void 180 days after they are issued, so cash them promptly.
Payments go out after the settlement receives final court approval and any appeals are resolved, which can take several months after the deadline.
What Proof Do I Need?
None. You do not need receipts, screenshots, or documentation of what you watched. The claim form asks for your name, contact information, the email associated with your FitOn account, and a Login ID only "if known" — the Login ID is optional. You then attest under penalty of perjury that you meet the class definition. Because eligibility rests on that attestation rather than on a mandatory administrator-issued code, this is a genuine no-proof settlement. (Claims may still be subject to audit and verification, so only file if you actually used FitOn.)

Filing online is free and lets you choose PayPal or Venmo instead of a check. If you do nothing, you will not receive a payment and, unless you exclude yourself, you give up your right to sue FitOn over the claims this settlement releases.
