A $117.5 million class action settlement has been reached in Hasson v. Comcast Cable Communications, LLC, Case No. 2:23-cv-05039-JMY, filed in the U.S. District Court for the Eastern District of Pennsylvania. The settlement resolves claims tied to a cybersecurity incident in October 2023 in which attackers gained unauthorized access to Comcast customer data between October 16 and October 19, 2023.
Comcast publicly disclosed the breach on December 18, 2023 and sent individual notices to affected customers. Approximately 36 million Xfinity customers were impacted. Comcast denies all wrongdoing and liability.
You are a Settlement Class Member if you reside in the United States or its territories and received an individual data breach notification from Comcast around December 18, 2023, informing you that your personal information may have been compromised.
If you received that notice by email or mail, you are eligible to file a claim.
There are three categories of benefits available:
1. Alternative Cash Payment — Estimated $50
All eligible class members can file for a direct cash payment estimated at $50, subject to pro rata adjustment based on the number of claims filed. No proof of losses is required, but you will need to verify your identity using the Class Member ID from the data breach notice Comcast sent you around December 2023. If you no longer have your notice, contact the settlement administrator through the official settlement website.
2. Out-of-Pocket Losses — Up to $10,000
If you spent money dealing with fraud, identity theft, or protecting yourself as a result of the breach, you can claim reimbursement for documented expenses including:
• Unreimbursed costs from identity theft or fraud
• Credit freeze placement or removal fees
• Credit monitoring or identity theft products purchased after October 16, 2023
• Notary, postage, mileage, and other miscellaneous costs
You must provide reasonable documentation such as bank statements, receipts, or invoices. Self-prepared documents alone are not sufficient.
3. Lost Time — Up to $150
If you spent time dealing with breach-related fraud or taking preventive measures, you can claim up to 5 hours at $30 per hour (in 15-minute increments). A self-certified explanation of how you spent that time is required.
Claims for Out-of-Pocket Losses and Lost Time are subject to a combined $10,000 cap. You receive the greater of your documented losses or the $50 alternative cash payment.
It depends on which benefit you choose:
Alternative Cash Payment ($50): No proof of losses is required, but you will need your Class Member ID from the breach notice Comcast sent you around December 2023 to verify your identity and file a claim. If you lost your notice, contact the settlement administrator through the official settlement website.
Out-of-Pocket Losses (up to $10,000): Yes. You must provide "Reasonable Documentation" such as credit card statements, bank statements, invoices, telephone records, or receipts. You also must sign an attestation under penalty of perjury. Self-prepared documents like handwritten receipts are not sufficient on their own but can support other documentation.
Lost Time (up to $150): No receipts needed, but you must provide a self-certified written explanation describing what you did and how much time you spent. Time is claimed in 15-minute increments up to 5 hours.
Identity Defense Services: No claim form or proof needed. You are automatically eligible to enroll using the activation code included in your breach notification.

No claim form is needed for this benefit. Enrollment codes were included in your breach notification email or mailing. You can pre-enroll now, and the service activates once the settlement becomes final.

The Final Approval Hearing will take place at the James A. Byrne U.S. Courthouse, 601 Market Street, Philadelphia, PA 19106.
Opt Out: If you want to keep your right to sue Comcast separately, you must mail a written Request for Exclusion postmarked by June 1, 2026 to the Kroll Settlement Administrator at the address above (ATTN: Exclusion Request). Include the case name and number, your name and address, a statement requesting exclusion, and your signature. Online opt-outs must be verified by June 1, 2026.
Object: If you disagree with any part of the settlement, you can file a written objection with the Court by June 1, 2026. You must include the case name and number, your contact information, the grounds for your objection, and whether you intend to appear at the Final Approval Hearing.
The Court will hold its Final Approval Hearing on July 7, 2026. If the settlement is approved and no appeals are filed, payments will be distributed as soon as possible after that. If appeals are filed, payments will be delayed until all appeals are resolved.
If you do nothing, you will remain a class member and give up your right to sue Comcast over claims related to this data breach. You will not receive a cash payment, but you will still be able to enroll in the free identity protection services after the settlement is finalized.
