What Is the McDonald's McRib Class Action Lawsuit?

A new consumer class action lawsuit claims McDonald's misleads customers by marketing the McRib sandwich as a rib-based pork product when it allegedly contains no actual rib meat.

According to the complaint, the product name “McRib” and the rib-shaped appearance of the patty would lead a reasonable consumer to believe the sandwich includes pork ribs. The lawsuit alleges this is not true.

Instead, the McRib is allegedly made from restructured pork using various non-rib cuts that are formed into a rib-like shape. The plaintiffs claim McDonald's does not clearly disclose this information in its advertising or menu materials.

McDonald's denies wrongdoing. This page covers a lawsuit that has been filed, not a settlement.

What Laws Are Being Alleged?

The complaint asserts claims including:

• Consumer fraud and deceptive practices
• Breach of express and implied warranties
• Unjust enrichment
• Violations of state consumer protection statutes

Who Filed the Class Action?

The lawsuit was filed by multiple named plaintiffs who allege they purchased McRib sandwiches believing they contained rib meat based on McDonald's branding and presentation.

Who Might Qualify If There Is a Settlement?

This is not a settlement yet, and no one can file a claim at this time.

The proposed class includes:

• A nationwide class of consumers who purchased a McRib in the United States during the alleged class period
• State-specific subclasses including California, New York, Illinois, and Washington DC

What’s Next for the McDonald’s McRib Class Action Lawsuit?

The McRib class action lawsuit is still in its early stages.

McDonald's is expected to respond to the complaint, typically by filing a motion to dismiss or an answer denying the allegations. If the Court allows the case to move forward, the parties may enter discovery.

During discovery, the plaintiffs may seek documents and testimony related to how the McRib is marketed, how its ingredients are described internally, how pricing decisions are made, and whether McDonald's considered consumer perceptions tied to the “McRib” name and rib-shaped patty.

After that, the plaintiffs may ask the Court to certify one or more proposed classes. The case could also be resolved earlier through dismissal, narrowing of claims, or settlement. McDonald's denies wrongdoing, and the Court has not ruled on the merits of the case.

When Will the Claim Form Be Available?

There is no claim form available at this time.

Claim forms are typically created only if a class action lawsuit settles and the Court approves a settlement agreement along with a notice and claims process. That often occurs many months or years after a lawsuit is filed.

If a claim form becomes available, this page will be updated.

How Many People Are Affected?

The lawsuit seeks to represent a nationwide class of consumers who purchased McRib sandwiches during the alleged class period, along with several state-specific subclasses.

Because the McRib is sold nationwide and has been offered repeatedly over the past several years, the number of potentially affected consumers could be very large. The exact number has not been determined by the Court.

When Will This Class Action Be Certified?

The class has not been certified.

Class certification typically occurs after early motions are resolved and some discovery has taken place. This process often takes a year or longer, depending on how the case proceeds. There is no certification timeline yet.

What Are the Odds This Class Action Is Settled?

It is too early to determine whether this case will settle.

Many consumer false advertising class actions eventually settle, but others are dismissed or narrowed before reaching that stage. No prediction can be made at this time.

What Is the Anticipated Settlement Amount?

There is no settlement amount.

No money has been agreed to or approved by the Court. Any future settlement amount would depend on legal rulings, alleged damages, and negotiations between the parties.

How Much Will Each Class Action Claimant Be Paid?

Unknown.

If a settlement is reached in the future, payments would depend on the total settlement amount, the number of approved claims, and the type of relief offered, such as cash payments, refunds, or vouchers. No payout structure exists at this time.

Is There a Claim Form Website?

No. A claim form will only exist if the case settles and the Court approves a claims process.
