Nationstar (Mr. Cooper) Florida Mortgage Fee Class Action Settlement — Up to $300

If Nationstar serviced your Florida mortgage and charged you for serving an unknown spouse or tenant, for "property maintenance" that was really a registration fee, or for an inspection that never happened, you may be owed a pro rata payment.

What Is This Settlement About?

A Settlement has been reached in Colombo v. Nationstar Mortgage LLC, a class action in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, Florida. The lawsuit alleges that Nationstar Mortgage LLC, now doing business as Mr. Cooper, charged certain fees on Florida mortgage loan accounts in violation of the Florida Consumer Collection Practices Act (FCCPA), the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), and in breach of contract.

The complaint alleges Nationstar charged borrowers (a) for service of process on an "unknown spouse" or "unknown tenant"; (b) for "property maintenance" where the charge was actually a fee to register the property in default with a governmental unit; and (c) to inspect the mortgaged property when the inspector did not actually inspect it. To resolve the case, Nationstar has agreed to pay a $1,500,000 Settlement Fund. Nationstar denies the allegations and any wrongdoing, and the Court has not decided who is right.

Who Qualifies?

The Settlement Class is defined as all persons in the State of Florida whose mortgage contracts have been or are being serviced by Nationstar — acting on behalf of US Bank and other note or mortgage holders — from May 29, 2013 until the date of the Final Approval Order, where Nationstar collected or attempted to collect, through the mortgage account statements, one or more of the following:


Most class members received an email or letter about the litigation. Excluded from the class are the presiding judge, Nationstar and its affiliates and their officers and directors, the released parties, the immediate families of those persons, anyone who timely opts out, and Class Counsel and their employees and immediate families.

How Much Can You Get?

Nationstar will pay a $1,500,000 Settlement Fund, which also covers the cost of notice and administration. Each Settlement Class Member who submits a timely, valid Claim Form will be paid on a pro rata basis, not to exceed $100 per fee class to which the claimant is a party, for a total not to exceed $300 per claimant. Because there are three challenged fee categories, a claimant charged all three could receive up to the $300 cap; the actual amount depends on how many valid claims are filed.

Any payments are made by physical check. Approved claimants will be sent their checks at the address listed on their Claim Form within 60 days following the Effective Date — the point at which the Settlement becomes final after Court approval and any appeals are resolved.

How to File a Claim

To receive a payment, you must complete and submit a valid Claim Form online or by mail through the official settlement website, FloridaNationstarLawsuit.com. The Claim Form must be submitted (postmarked, if mailed) by August 15, 2026.

To file, you will need the Claim ID and Unique ID printed on the email or postcard Notice you received — both the online portal and the paper form require them. If you did not receive a Notice or cannot locate your IDs, you can request a copy through the settlement website. No receipts or out-of-pocket documentation are required, but the Claim Form must be completed fully, signed, and verified. Only one Claim Form may be submitted per Settlement Class Member unless the Court orders otherwise.

Your Other Options

If you do not want to be bound by the Settlement and want to keep the right to sue Nationstar on your own about these issues, you must exclude yourself ("opt out") by mailing a signed request, postmarked no later than August 17, 2026. You cannot opt out by phone, by email, or at the website, and you may opt out only for yourself. If you exclude yourself, you give up any payment from the Settlement.

If you stay in the class, you may object to any part of the Settlement. A written objection must meet the requirements set out in the official Notice, be filed with the Court, and be postmarked by August 31, 2026. The Court has scheduled a Final Approval Hearing for September 14, 2026 at 9:00 a.m. at the Palm Beach County courthouse in West Palm Beach, Florida, before the Honorable James Sherman, to decide whether the Settlement is fair, reasonable, and adequate. The hearing date can change without further notice, so check the settlement website for updates. If you do nothing, you will not receive a payment and, unless you opt out, you will be bound by the Court's judgment.

The Lawyers and Costs

The Court has appointed Class Counsel to represent the Settlement Class at no charge to class members. Class Counsel intend to ask the Court for up to $1,300,000 in attorneys' fees and $60,000 in expenses, plus a service award of up to $10,000 for the class representative. These amounts will be paid separately from the $1,500,000 Settlement Fund, so they do not reduce class member payments. The Court will decide the final amounts.
