What's This Settlement About?
This lawsuit involves four products made by Smitty’s Supply, Inc. and CAM2 International:Super S Supertrac 303 Tractor Hydraulic Fluid
Super S 303 Tractor Hydraulic Fluid
Cam2 ProMax 303 Tractor Hydraulic Oil
Cam2 303 Tractor Hydraulic Oil (“303 THF Products”).
The Plaintiffs in this lawsuit allege that the Manufacturer Defendants’ 303 THF Products did not meet the equipment manufacturers’ specifications or provide the performance benefits listed on the product labels, that the Manufacturer Defendants’ 303 THF Products were made with inappropriate ingredients including used transformer oil, used turbine oil, and line flush, and that use of the Manufacturer Defendants’ 303 THF Products in equipment causes damage to various parts of the equipment.
How Do I Qualify?
The Settlement includes anyone who purchased Super S Supertrac 303 Tractor Hydraulic Fluid, Super S 303 Tractor Hydraulic Fluid, Cam2 ProMax 303 Tractor Hydraulic Oil, and/or Cam2 303 Tractor Hydraulic Oil from Tractor Supply Company (including Del’s Feed & Farm Supply locations), Orscheln Farm and Home, Rural King, or Atwood stores between December 1, 2013 and the present. The only exception is for those who only purchased Super S Super Trac 303 Tractor Hydraulic Fluid in the state of Missouri. If you believe you are a class member and have not received a personalized Notice with a summary of your purchase data, you will need to file a Class Membership Form HERE. If you received a personalized Mailed Class Notice with a summary of your purchase data and you would like to correct that data, you will need to file a Correction Form HERE. If you believe your equipment has been damaged as a result of using the eligible 303 THF Products, you will need to file a Damages Claim Form HERE.The settlement establishes a $18,825,000.00 “Class Settlement Fund” that will be paid to Settlement Class Members as: cash awards of up to 100% of the purchase price paid for the 303 Tractor Hydraulic Fluid Products and reimbursement for the costs of any repairs, parts, and specific equipment damage that a Settlement Class Member claims resulted from, in whole or in part, the use of the 303 Tractor Hydraulic Fluid Products during the Class Period. Class Counsel will seek an incentive payment of $5,000.00 for each of the Class Representatives.
How Do I File a Claim?
You must timely submit a Retailer Class Membership Form in order to receive any monetary award/Repair/Parts/Specific Equipment Damage as part of the Proposed Retailer Settlement.
