Settlement Summary

This class action settlement alleges that between January 1, 2019 and January 24, 2020, Walmart over-collected the Prepaid Wireless Telecommunications Service Charge (known as PWETSC) on retail purchases made in its stores in Missouri. Walmart denies any and all liability or wrongdoing with respect to the claims alleged in the lawsuit but would like to settle the case because a settlement will avoid the risk, expense and distraction of continued litigation. Walmart will fund a Class Settlement Amount of up to $600,000. The Court will hold a final approval hearing (Fairness Hearing) on March 17, 2022 at 1:30 p.m. to decide whether to approve the Settlement. If the Settlement receives final approval, settlement payments shall be sent in a timely manner, provided there are no appeals to the Court’s decision.

How Do I Qualify?

The Court has decided that, for settlement purposes, any person who purchased, in the state of Missouri, a Prepaid Wireless Telecommunications Service Product from a Walmart store or a Sam’s Club store for a purpose other than resale, between January 1, 2019 and January 31, 2020, limited to in-store purchases and not including purchases online/via internet, belong to the Settlement Class.

What Can I Get?

Eligible Settlement Class Members can get up to $20 per household. If you provide proof of receipt or charges from Walmart or Sam's Club you can receive a higher payout, depending on the total valid claims that will be submitted that will split the $600,000 settlement fund provided by Walmart.

How Do I File a Claim and Get Paid?

To make a claim and receive a payment, you must complete and submit a Claim Form online HERE by January 11, 2022. Failure to provide complete and accurate information could result in a denial of your Claim. Alternatively, a Claim Form may be downloaded and printed completed HERE , signed and mailed (post-marked) by the Claim Filing Deadline of January 11, 2022. Only Claims that are timely, complete, signed and valid will be approved by the Claims Administrator.
