What Is This Settlement About?

Alfa Mutual Insurance Company has agreed to settle a class action lawsuit alleging it underpaid Alabama policyholders on first-party total-loss auto claims by leaving certain required fees and taxes out of the actual cash value payment.

The lawsuit, Demetria Walker v. Alfa Mutual Insurance Company, is pending in the Circuit Court of Barbour County, Alabama, Eufaula Division (Case No. 69-CV-2024-900015.00). The complaint, filed March 13, 2024, alleges Alfa breached its Alabama auto policies by failing to pay full "Purchasing Fees" — title fees and registration transfer fees, including applicable taxes — when a covered vehicle was declared a total loss.

Alfa denies all liability, including that it failed to fully pay taxes on total-loss claims, and the court has not ruled on the merits. The parties agreed to settle to avoid the cost and uncertainty of continued litigation.

Who Qualifies?

You are a settlement class member if you were insured under an Alabama automobile insurance policy issued by Alfa Mutual Insurance Company or an affiliated entity, and:

The class covers both leased and owned vehicles and is estimated to include roughly 55,000 claims. Excluded from the class are people who already received a full Purchasing Fees payment, people who signed a release covering these claims, and anyone who already pursued an individual appraisal, arbitration, or lawsuit over the same total-loss claim. This case is separate from the similar State Farm Alabama total-loss purchasing fees settlement already covered on OCA, which involves a different insurer and a different class period.

How Much Can You Get?

Each settlement class member who submits a valid, timely claim is eligible to receive up to $24.00 — the amount the settlement agreement assigns to the registration transfer fee (including the ad valorem refund credit fee, $6.00) and the title fee ($18.00) — less any portion of those fees Alfa already paid on the original claim. Class members are also entitled to any taxes that were not paid as part of the original total-loss payment.

There is no single capped settlement fund that payments are drawn down from. Instead, Alfa pays each approved claim directly. Separately, Alfa has agreed not to oppose a request from Class Counsel for attorneys' fees and costs of up to $450,000 and a service award of up to $10,000 to the class representative, both paid by Alfa apart from the payments to the class.

How to File a Claim

Claims can be filed online at the official settlement website or by mailing the detachable, postage-prepaid Claim Form included with the Postcard Notice. The deadline to file — online or postmarked — is August 3, 2026.

To file online, you will need the ALFA Claimant ID printed on your Postcard Notice. If you file without that ID, the claims administrator will require supporting documentation before your claim can be processed. File at ALATotalLoss.com.

Important Deadlines

If you do nothing, you remain in the class, receive no payment, and give up the right to sue Alfa over the Purchasing Fees claims released by the settlement. Payments are expected to go out within 90 days after the settlement becomes effective, assuming no appeals are filed.

Watch Out for Scams

File only through the official settlement website. The claims administrator will not ask you to pay a fee, provide a wire transfer, or send a gift card to receive a payment that is already owed to you.
