Third Round of Progressive NY Total-Loss Payments Has Gone Out

The $48 million Volino v. Progressive Casualty Insurance Co. settlement (Case No. 1:21-cv-06243-LGS, S.D.N.Y.) sent its third round of automatic payments on May 1, 2026, according to the official settlement website. The case resolved claims against Progressive Advanced Insurance Company, Progressive Specialty Insurance Company, Progressive Max Insurance Company, and Progressive Casualty Insurance Company that they systematically underpaid New York policyholders and third-party claimants on total-loss vehicle claims by basing actual-cash-value on Mitchell International "Instant Report" valuations that applied a "Projected Sold Adjustment" reducing the comparable-vehicle values. Approximately $31.2 million of the $48 million fund was allocated to class members (with the remainder paying court-approved fees, expenses, and service awards), and the notice estimated an average check of about $335. Two earlier payment rounds had already been distributed from the same fund. About 93,000 class members are receiving automatic payments — there is no claim form, no Notice ID to enter, and no deadline to file.

Who Is Getting Paid

The settlement classes were defined by Progressive's own records, which is why no claim form is needed. Eligibility is automatic for:

• New York Progressive auto-policy holders whose vehicles were declared total losses between July 28, 2015 and August 20, 2024.

• New York third-party claimants whose vehicles were declared total losses by Progressive between July 28, 2018 and August 20, 2024.

Class members do not need to do anything to receive a payment. Per-claimant amounts vary because they are calculated from each underlying total-loss claim file, not split evenly across the class.

What "Automatic Distribution" Means in Practice

Settlements that distribute automatically use the defendant's claim records to identify recipients and addresses on file. That is why the Volino payments are arriving in rounds — the administrator works through batches as records are validated and address updates are processed. If your address with Progressive has changed since your total-loss claim, an old check may have been returned and re-issued in a later round. The official settlement website is the only place that can confirm the status of an individual payment.

How This Compares to the Georgia Progressive Settlement

Volino is a separate New York case. Progressive's parallel $43 million Brown v. Progressive total-loss settlement covers Georgia policyholders and runs on its own timeline and its own official website. The two pages are not interchangeable — class members in one state are not class members in the other, even though the underlying allegation (a "Projected Sold Adjustment" reducing comparable-vehicle values) is similar.
