AT&T has agreed to a proposed class action settlement that would pay $1,750,000 (the "Common Fund") to resolve claims that its Washington employees were not properly paid for missed and noncompliant meal and rest periods. The plaintiffs allege that the AT&T entities violated Washington law by failing to compensate non-exempt employees for meal and rest breaks that were missed or did not comply with state requirements. AT&T disputes the claims and denies that it violated the law. Who Qualifies?
You are a Settlement Class Member if AT&T's records show you were employed by AT&T Mobility Services LLC; New Cingular Wireless PCS, LLC; AT&T Enterprises, LLC (f/k/a AT&T Corp.); AT&T Services, Inc.; and/or AT&T Inc. in Washington as a non-exempt employee at any time from July 11, 2022 through May 6, 2026 (the date of preliminary approval). This is the "Settlement Class Period."
You are receiving a mailed notice because AT&T's records indicate you fall within that class. If you are not sure whether you are included, you can confirm your status through the official settlement website. This settlement is limited to Washington non-exempt employees of the AT&T entities named above.
How Much Can You Get?
Every Settlement Class Member who does not exclude themselves will receive a pro rata share of the fund based on how many weeks they worked during the class period compared to the total weeks worked by all class members. Because payments are weeks-based, individual amounts vary; the estimated amount for your work history is printed on your mailed notice. Payments are characterized as 50 percent wages (reported on a W-2) and 50 percent non-wage damages, penalties, and interest (reported on a 1099), less applicable payroll taxes.
Before class members are paid, the court will consider deductions from the Common Fund, including an attorneys' fee request of $583,333.33 plus costs and expenses of up to $5,000, settlement administration costs, and service awards for the class representatives of up to $35,000 each. The court decides the final amounts and may award less than requested. Whether the settlement is approved does not depend on how much the court awards in fees or service awards.
Do You Need to File a Claim?
No. There is no claim form in this settlement. If the court grants final approval and you do not opt out, the settlement administrator will automatically mail your payment — you do not need to do anything to receive it. The most important step is to make sure the administrator has your correct mailing address, so update it through the official settlement website if it has changed.
The settlement website also offers an optional payment selection form, which you access using the Notice ID and last name from your mailed notice. That form lets you choose how you receive your payment; it is not required to be paid. If you never received a notice or lost your Notice ID, use the contact form on the official settlement website to reach the administrator.
Your Options and Deadlines
You have three choices. First, you can do nothing (and update your address if needed): you stay in the class, receive a payment, and release the wage claims described in the settlement against AT&T. Second, you can exclude yourself (opt out) by mailing a signed written request to the settlement administrator, postmarked no later than August 6, 2026 — this is the only option that preserves your right to sue AT&T separately over these claims, but it means you receive no payment. Third, you can object to the settlement if you stay in the class; written objections must be filed with the court and mailed to counsel by August 6, 2026.
The court's Final Approval Hearing is scheduled for September 11, 2026 at 9:00 A.M. before Judge Jessica Manca. At that hearing the court will decide whether the settlement is fair, reasonable, and adequate. The date can change by court order, so check the official settlement website to confirm. If the settlement is approved, payments are mailed after any appeals are resolved, and each check expires 180 days after it is issued.
