A federal judge has approved a $425 million class action settlement over allegations that Capital One paid lower interest on its older 360 Savings accounts while quietly offering a higher-yield 360 Performance Savings account to newer customers. If you had a Capital One 360 Savings account at any time from September 18, 2019 through June 16, 2025, you are included in the settlement.
The lawsuit alleges Capital One kept the interest rate on 360 Savings lower than the interest rate on its 360 Performance Savings account, and did not clearly disclose the difference while marketing 360 Savings as a high-yield product. A prior settlement proposal was rejected at a court hearing on November 6, 2025; the revised version was approved at the April 20, 2026 final approval hearing.
The revised settlement provides two main benefits:
• $425 million settlement fund to pay cash payments to current and former 360 Savings accountholders.
• Interest rate match benefit for current 360 Savings accountholders, designed to treat 360 Savings accountholders the same as 360 Performance Savings accountholders for at least two years after the settlement becomes effective.
You may be included if you maintained a Capital One 360 Savings account at any time during the class period:
• Class period: September 18, 2019 through June 16, 2025.
• Includes current and former accountholders, including joint and co-holders (payments are issued only to the primary accountholder on the account).
How Do I Find Class Action Settlements?
Find all the latest class actions you can qualify for by getting notified of new lawsuits as soon as they are open to claims:
Cash payments are expected to be based on the approximate additional interest you would have earned if your 360 Savings account paid the interest rate applicable to the 360 Performance Savings account during the class period.
The settlement administrator has not yet determined individual payment amounts. If you want to make sure you receive your payment, consider selecting electronic payment.
No claim form is required. Payments are automatic for eligible class members based on Capital One’s records.
• If your payment is $5 or more and you do not choose electronic payment, a check is expected to be mailed to your last known address.
• If your payment is less than $5, you will only receive it if you select electronic payment by the deadline.
• Deadline to choose electronic payment / update address: March 30, 2026 (passed).
• Opt-out deadline: March 30, 2026 (passed).
• Objection deadline: March 30, 2026 (passed).
• Final approval: Granted on April 20, 2026.
• Expected payment date: On or about July 21, 2026, if there is no appeal.
If there is no appeal of the final approval order, payments are expected to be issued on or about July 21, 2026. An appeal could push that timing back.
Checks will not be mailed for amounts under $5. Class members owed less than $5 needed to elect electronic payment before the March 30, 2026 deadline in order to be paid.
For current accountholders, the settlement also provides an interest-rate match benefit that begins no later than a short period after the settlement becomes effective.
