What Changed Recently?

The settlement is now open for claims. It resolves Anderson v. Bauer Built Inc. d/b/a Bauer Built Tire & Service, Case No. 2026CH05015, in the Circuit Court of Cook County, Illinois, Chancery Division. The case was first filed in federal court in Wisconsin in March 2024; that court dismissed it for lack of jurisdiction under the Class Action Fairness Act, and it was refiled in Cook County on May 26, 2026, where the parties filed an amended settlement in July 2026.

The lawsuit alleges that during a cyberattack on Bauer Built’s computer systems between April 16 and April 21, 2023, files containing personal information were accessed, including names, Social Security numbers, government ID, driver’s license and state ID numbers, and financial account numbers. Bauer Built denies that it did anything wrong, and the court has not decided who is right.

Who Qualifies?

The class is all individuals residing in the United States who were sent notice by or on behalf of Bauer Built Inc. that their personal information may have been affected by the April 2023 incident. Membership is decided by Bauer Built’s notice records; the company began sending those notices on December 8, 2023, and the settlement agreement puts the class at about 4,876 people. The judge and the judge’s family and staff, Bauer Built’s officers and directors, anyone who opts out and anyone involved in the attack are excluded.

How Much Can You Get?

Every class member who files a valid claim can enroll in two years of credit monitoring from all three credit bureaus, with $1 million in identity theft protection, plus one of two options:

• Option 1 — documented losses, any or all of: up to $500 for out-of-pocket expenses caused by the incident, such as credit report or monitoring fees or the cost of replacing IDs; up to $5,000 for losses from fraud or identity theft after April 16, 2023, with proof that the money was lost and not recovered; and up to four hours of lost time at $25 an hour ($100), which counts toward the $500 limit.
• Option 2 — a $45 Alternative Cash Payment, with no documentation.

Bauer Built pays these benefits directly, and separately pays administration costs, attorneys’ fees of up to $125,000 and a $2,500 service award, all subject to court approval, so those amounts do not reduce class members’ benefits.

What Proof or Notice ID Is Required?

The online claim form opens with a login that requires the LoginID and PIN printed at the top of the notice, so this page lists proof as required even though the $45 payment needs no receipts. Class members who cannot find them can ask the administrator to resend them by providing a full name and mailing address through the settlement website. A printable claim form can also be downloaded and mailed or emailed with any supporting documents.

Out-of-pocket and fraud losses require proof such as receipts or bank statements; a claimant’s own notes can explain the proof but are not enough alone. Fraud losses also require an explanation of why the loss was likely caused by the incident and a showing of efforts to avoid or recover it. Lost time needs no documents, only a short description of what was done.

What Is the Deadline?

Claims must be submitted online or by email by December 31, 2026, or mailed with a postmark no later than December 31, 2026. Requests to opt out and objections are due December 1, 2026.

How Do You Take Action?

Claims are filed on the official Bauer Security Incident Settlement website with the LoginID and PIN from the notice, or with the printable claim form from the same site.

What Happens Next?

The court will hold the final approval hearing on January 27, 2027, at 11:00 a.m. Central time, by Zoom, before Judge Lynn Weaver-Boyle; the settlement website lists the connection details. If the court approves the settlement, the administrator, Simpluris, emails credit monitoring enrollment codes and issues payments after any appeals are resolved. Settlement checks expire 90 days after they are issued.
