What Changed Recently?
Crossroads Trading Co., Inc., the buy-sell-trade used clothing retailer, agreed to pay $600,000 to settle claims over a data security incident on or about February 15, 2025. According to the settlement agreement, the incident may have affected about 60,041 current and former employees, customers and other people, and the information involved may include names, dates of birth, addresses, contact information, driver’s license or state ID numbers, Social Security numbers, financial account information and passport information. Crossroads began mailing breach notices on March 26, 2025.
Lawsuits were first filed in federal court in Northern California in April 2025 and consolidated as In re: Crossroads Trading, Inc. Data Breach Litigation. After the parties reached a settlement, the plaintiffs dismissed the federal case and refiled in state court on October 31, 2025 as Wright, et al. v. Crossroads Trading Co., Inc., Case No. 25CV479119, in the Superior Court of California for Santa Clara County, where the settlement is now pending. The plaintiffs allege Crossroads failed to properly protect the information. Crossroads denies doing anything wrong, says it had appropriate safeguards in place and that no one was harmed, and the court has not decided who is right.
Who Qualifies?
The settlement class is all individuals residing in the United States whose private information may have been compromised or otherwise affected in the Crossroads data security incident, including everyone who received a notice of the breach. Settlement notice went by postcard to the same list of roughly 60,041 addresses that received the original breach letter.
Excluded are the judges presiding over the case with their immediate families and staff; Crossroads and its subsidiaries, parent companies, successors, predecessors and any entity it controls; people who opted out by the September 14, 2026 deadline; and the successors or assigns of anyone excluded.
How Much Can You Get?
Everything is paid from the $600,000 fund, which is non-reversionary. Administration costs, attorneys’ fees, costs and service awards come out first. Class Counsel will ask for fees of up to one-third of the fund, or $200,000, plus reasonable costs, and up to $2,500 for each of the six class representatives. The court decides both requests.
Each class member chooses one of two cash options:
Alternative Cash Payment, estimated at $25. No documentation is needed. The amount is whatever is left after the other payments, divided equally among everyone who picks this option, so it can be higher or lower than the estimate.
Documented Loss Payment, up to $5,000. Reimbursement for unreimbursed losses fairly traceable to the breach and incurred on or after February 15, 2025, such as identity theft or fraud costs, credit reports and credit monitoring or fraud resolution services bought between February 15, 2025 and October 13, 2026, and per-minute phone or internet charges. Credit monitoring bought for this purpose needs a sworn statement that it was purchased primarily because of the breach. A deficient documented-loss claim that is not fixed is converted to the $25 option rather than denied.
On top of either option:
California Statutory Cash Payment, estimated at $100. Open to current California residents and anyone who lived in California at any point between February 15, 2025 and October 13, 2026. A sworn attestation on the claim form is enough to prove residency. It can be reduced pro rata depending on how many people file.
Credit monitoring. Every class member can claim two years of three-bureau credit monitoring, paid from the fund.
Separately, Crossroads says it has enhanced its cybersecurity measures and will maintain them for at least five years, at an estimated cost of $200,000 that is not taken from the fund. Crossroads can cancel the settlement if more than 150 class members opted out.
What Proof or Notice ID Is Required?
Every class member on the settlement list was given a unique Class Member ID, printed on the postcard notice, and the claim form asks for it. That is why this page marks Proof Required: Yes, even though the $25 option needs no receipts. The settlement agreement says a claim filed without the ID is not rejected outright: the administrator makes reasonable efforts to confirm the person is a class member, and someone who believes they are in the class but never got the postcard has a reasonable chance to show it, for example with the original breach notice.
A documented-loss claim needs reasonable documentation such as credit card or bank statements, invoices, phone records or receipts. The California payment needs only a sworn statement of residency.
What Is the Deadline?
Claims must be submitted online or postmarked on or before October 13, 2026. The official documents do not give a time of day or time zone for online filing, so this page gives only the date. The deadlines to opt out and to object were September 14, 2026 and have passed.
How Do You Take Action?
File on the official settlement website, Crossroads Settlement, using the Submit Claim button, or download the claim form there and mail it. Have the Class Member ID from the postcard ready, choose the $25 payment or documented losses, add the California payment if it applies, select credit monitoring if wanted, and pick a payment method; the settlement offers digital payment options, and anyone who does not choose one is paid by paper check. Kroll Settlement Administration is the court-approved administrator.
What Happens Next?
The court will hold the final approval hearing on January 13, 2027 at 1:30 p.m. Pacific Time in Department 19 of the Santa Clara County Superior Court, and the date can change without further notice. If the court approves the settlement, payments go out within 60 days after the settlement becomes effective or after all claims are processed, whichever is later. If no one objected, the agreement says the settlement becomes effective the day after the final approval order; an appeal would delay it. Paper checks must be cashed within 120 days.

Questions
Can I get both the $25 payment and the $100 California payment?
Yes, if you qualify for both. The California Statutory Cash Payment, estimated at $100, can be claimed together with either the estimated $25 Alternative Cash Payment or a Documented Loss Payment. It is open to current California residents and anyone who lived in California at any point between February 15, 2025 and October 13, 2026, and a sworn statement on the claim form is enough to show residency. Both amounts can be reduced pro rata depending on how many people file.
Can I claim the $25 and documented losses at the same time?
No. Each class member chooses one: the estimated $25 Alternative Cash Payment with no documentation, or reimbursement of documented losses up to $5,000. If a documented-loss claim is deficient and not fixed, the settlement agreement says it is treated as a claim for the Alternative Cash Payment rather than denied.
I lost the postcard. Can I still file?
The settlement agreement says a claim submitted without the Class Member ID is not automatically rejected; the administrator will make reasonable efforts to confirm the claimant is a class member, and someone who believes they are in the class but did not receive the postcard gets a reasonable chance to show it. Having the ID from the postcard makes the claim easier to match.
When will Crossroads settlement payments be sent?
No payment date has been set. The court will decide whether to approve the settlement at the final approval hearing on January 13, 2027. Under the settlement agreement, payments go out within 60 days after the settlement becomes effective or after all claims are processed, whichever is later, and any appeal would delay that. Checks must be cashed within 120 days.
What happens to money that is not claimed?
The settlement is non-reversionary, so no money goes back to Crossroads after it takes effect. Money left 120 days after payments go out is redistributed to claimants who cashed their first payment, as long as the average check would be at least $3. After that, any remainder goes to the Boys & Girls Clubs of Oakland.
