Electronics for Imaging (EFI) Data Breach Settlement: $75 Cash or Up to $5,000 for 2024 Cyberattack Victims

U.S. residents whose personal information was impacted in the September 2024 cyberattack on Electronics for Imaging, Inc. may qualify to claim an estimated $75 with no documentation, or up to $5,000 in documented losses, plus three years of credit monitoring, from the EFI data breach class action settlement. Claims are open through December 22, 2026.

Current Status

Claims are open. Online claims must be submitted, and mailed claims postmarked, by December 22, 2026. The Superior Court of Merrimack County, New Hampshire, has authorized notice of the proposed settlement, and the final approval hearing is scheduled for January 26, 2027, at 8:30 a.m. Eastern time. No benefits will be paid unless the court grants final approval, and no payment date had been announced as of October 3, 2026.

What Changed Recently?

The court-authorized notice opened the claims process in Hibbard, Nelson v. Electronics for Imaging, Inc., a class action in the Superior Court of Merrimack County, New Hampshire. The lawsuit alleges that during a targeted cyberattack on EFI’s computer systems in September 2024, files containing personal information were accessed. According to the notice, those files may have included names, addresses, phone numbers, dates of birth, photo identification or driver’s licenses, and Social Security numbers.

EFI, a printing technology company, denies that it did anything wrong, and the court has not decided who is right. The parties agreed to settle to avoid the cost and risk of continued litigation.

Who Qualifies?

The class includes all individuals residing in the United States whose private information was impacted in the data incident affecting EFI on or around September 2024, including everyone who received notice of the incident. EFI, judges assigned to the case and their staff and families, anyone convicted of causing the attack, and people who opt out are excluded.

How Much Can You Get?

Every class member can enroll in three years of CyEx Identity Defense Complete, which includes credit file monitoring, dark web scanning, public records monitoring, access to fraud resolution agents and $1 million in identity theft insurance. Class members can also choose cash: Losses must have occurred between September 17, 2024 and December 22, 2026. All cash benefits together are capped at $300,000; if valid claims add up to more, every payment is reduced proportionally. The $75 figure is an estimate, not a guaranteed amount.

What Proof or Notice ID Is Required?

Proof is required. The online claim form asks for the LoginID and PIN printed on the notice EFI’s administrator sent to class members, and anyone who cannot find them can request them by giving their full name and mailing address. The printable claim form asks for the LoginID only if known and can be mailed or emailed instead.

The $75 alternative payment and the lost-time payment require no documents. Ordinary and extraordinary loss claims require receipts or similar records; the notice says self-prepared notes can support other proof but are not enough on their own.

What Is the Deadline?

Online claims must be submitted by December 22, 2026. Paper claims, with any supporting documents, must be postmarked by December 22, 2026. The deadline to opt out or object is November 23, 2026.

How Do You Take Action?

Claims are filed on the official EFI Data Settlement website, which also offers a printable claim form, the notice and the settlement agreement. The claim form lets claimants choose an electronic payment method such as PayPal, Venmo or Zelle. Only one claim is allowed per person.

What Happens Next?

The court will hold the final approval hearing on January 26, 2027, at 8:30 a.m. Eastern time in Courtroom 3 of the Merrimack County Superior Court in Concord, New Hampshire. Class counsel are asking for $165,000 in attorneys’ fees and costs and $2,500 service awards for each of the two class representatives, all paid by EFI separately from the cash benefits. Payments go out only after final approval and the resolution of any appeals. The hearing date and format can change, and updates are posted on the settlement website.

Questions

Can the EFI $75 payment be combined with lost time or out-of-pocket losses?

No. The $75 Alternative Cash Payment replaces every other cash option. Claimants choose either the alternative payment or some combination of documented losses and lost time. Credit monitoring can be claimed alongside either choice.

Do attorneys’ fees reduce the $300,000 available for EFI cash benefits?

No. The notice says EFI will pay the requested $165,000 in attorneys’ fees and costs and the $2,500 service awards separately. The $300,000 cap applies only to the cash benefits paid to class members, and payments shrink proportionally only if valid claims exceed that cap.

What is the difference between ordinary and extraordinary losses in the EFI settlement?

Ordinary losses, up to $300, are routine costs such as credit report or credit freeze fees, ID replacement and postage. Extraordinary losses, up to $5,000, are money lost to identity theft or fraud that the claimant shows was caused by the incident, was not reimbursed elsewhere, and that the claimant tried to prevent or recover. Both require receipts or similar records dated between September 17, 2024 and December 22, 2026.

How are EFI settlement payments sent?

The claim form offers electronic payment options including PayPal, Venmo and Zelle. Payments are made only after the court grants final approval and any appeals are resolved.
