Who Was Covered?
The settlement class covers U.S. residents whose Private Information was potentially or actually compromised in the incident, including everyone who was sent notice by Proliance or its representative about the February 2023 Data Security Incident. According to the settlement notice, the files accessed contained some or all of the following, varying by individual: names, Social Security numbers, dates of birth, telephone numbers, and financial information, along with protected health information such as medical information, diagnosis and treatment information, health insurance information, and medical record numbers. Class members were assigned a Class Member ID, which was mailed to them on a Postcard Notice and was needed to file a claim or enroll in monitoring.
What the Settlement Offered
Class members who filed a valid, timely claim could choose among the following benefits:
Up to $5,000 in documented out-of-pocket losses fairly traceable to the breach (for example, fraud losses, unreimbursed bank fees, and certain out-of-pocket costs), supported by documentation.
A pro rata cash fund payment of up to $599. Because this payment is a pro rata share of the net settlement fund, the actual amount depends on how many valid claims were filed and could be well below the cap — the notice illustrates that if about 5% of the class claims both the cash payment and monitoring, the payment would be roughly $60.
Two years of CyEx "Medical Shield Complete." Medical identity-theft protection and monitoring, which also includes single-bureau credit monitoring. Class members enroll using their Class Member ID.
The settlement fund of $4,450,000 also covers court-approved attorneys' fees and expenses, settlement administration and notice costs, and service awards for the class representatives, before class-member benefits are paid.
What Happens Next?
The court's final fairness hearing was scheduled for June 26, 2026 in King County Superior Court in Washington. If the court grants final approval and no appeals delay the process, the settlement administrator will begin issuing payments to class members who filed valid claims. Payment timing after approval varies and can take several weeks to months. The official settlement website is the best place to check the case status and payment updates.
If you filed a claim, watch for your payment by the method you selected and be alert for scams: legitimate settlement administrators never charge a fee to release a class action payment and will not ask for your banking passwords or a "processing payment" to send your check.
