What Is This Settlement About?

Total Vision, LLC ("Total Vision") is a California-based vision and eye-care group. According to the court-approved notice, a data security incident occurred at Total Vision on October 30, 2020, and on or about December 4, 2020, Total Vision mailed notices of the incident to potentially affected people with California addresses. Plaintiffs allege that Total Vision and related defendants failed to adequately protect patients' personal and confidential medical information. Total Vision denies any wrongdoing, and no court has decided who is right; the parties agreed to settle to avoid the cost and risk of continued litigation.

The consolidated class action, Ramey, et al. v. Total Vision, LLC, et al., Case No. 37-2021-00002017-CU-MC-CTL, is pending in the Superior Court of California, County of San Diego, before the Honorable Carolyn Caietti. The amended complaint asserts claims for violations of California's Unfair Competition Law, negligence, breach of implied contract, violations of the California Confidentiality of Medical Information Act (CMIA), and breach of California's data-breach notification law. On May 15, 2026, the court granted preliminary approval of the settlement and directed that notice be mailed to the class.

Under the settlement, Total Vision will pay a non-reversionary Gross Settlement Amount (GSA) of $475,000.00. Who Qualifies?

The Settlement Class is all persons to whom Total Vision, LLC sent, by direct mail, notices of the Data Security Incident addressed to a California address. Total Vision has prepared a Settlement Class List from its records, which it represents is made up of approximately 88,722 people. Only people on that list may submit a Claim Form.

How Much Can You Get?

There are two benefits you can claim, plus a business-practice commitment that applies automatically:

Pro-Rata Cash Payment — a cash payment equal to your pro-rata share of the Net Settlement Fund. The Net Settlement Fund is what remains of the $475,000 GSA (plus interest) after court-approved deductions: settlement administration costs of up to $100,250.00, settlement class counsel's fees of up to $158,333.33 and costs of about $22,000.00, and incentive awards of up to $5,000 to each of the two class representatives. Approved out-of-pocket claims are then subtracted, and the remainder is divided among the class members who submit valid cash claims. Because the payment is pro rata, the exact amount depends on how many people file. Payments are made by mailed check unless you elect an electronic payment.

Reimbursement of Documented Out-of-Pocket Expenses — up to $1,000.00 for documented, unreimbursed out-of-pocket losses fairly traceable to the Data Security Incident and incurred between October 30, 2020 and October 5, 2026. Covered examples include losses from documented identity theft or fraud, card cancellation or replacement fees, credit-report and credit-freeze costs, the cost of replacing a driver's license or state ID, and certain bank fees (late, overdraft, returned-check) tied to documented fraud. Costs of credit monitoring or identity-theft protection qualify only if incurred between February 28, 2022 and October 5, 2026. Your own attorneys' fees are not reimbursable.

Business Practice Commitments — Total Vision has agreed to maintain improved data-security measures for at least two years, valued in excess of $224,000 annually. Those costs are Total Vision's responsibility, separate from the GSA, and every class member benefits from them automatically.

How to File a Claim

The deadline to submit a Claim Form is October 5, 2026. If you are claiming only the Pro-Rata Cash Payment, you can file online at the official settlement website, Total Vision Settlement.com, or mail a completed Claim Form postmarked by October 5, 2026. To file the cash claim you simply complete your contact information (Section II of the form); the Claim Number printed on your notice is optional and only helps confirm your record.

If you are also seeking reimbursement of Documented Out-of-Pocket Expenses, you must file by mail — this option cannot be submitted online. Complete Section IV, sign the attestation in Section V under penalty of perjury, and include reasonable documentation supporting each claimed expense (for example, a police report, account statements showing unauthorized charges, or receipts). If your out-of-pocket documentation is incomplete, only that portion is affected; the administrator reviews each claim for eligibility.

You can choose to receive your cash payment by mailed check or by electronic payment through PayPal, Venmo, or Zelle by providing the email address tied to that account on the form. If you cannot locate your Claim Number, you can request it through the official settlement website.

Key Deadlines


If you do nothing, you remain in the Settlement Class and give up your right to sue Total Vision and the other defendants over the Data Security Incident, but you will not receive any cash payment. To receive a payment, you must submit a valid Claim Form by October 5, 2026. Benefits are distributed only after the court grants final approval and the settlement becomes final; if your claim is approved, a check is mailed within 60 days of the Effective Date.
