A settlement has been reached in a class action accusing SP Plus Corporation — the company that operated the parking facilities at Dayton International Airport — of printing the expiration dates of customers' credit and debit cards on electronically printed paper receipts. Federal law, the Fair and Accurate Credit Transactions Act (FACTA), prohibits merchants from including a card's expiration date or more than the last five digits of the card number on a printed receipt handed to the customer.
The case, captioned Collier v. SP Plus Corp., is pending in the Circuit Court of Cook County, Illinois, Chancery Division. SP Plus denies any wrongdoing and the court has not decided who is right. The company agreed to settle to avoid the cost and risk of continued litigation. Under the settlement, people who paid to park at the Dayton airport with a card during the covered period can claim a parking voucher worth up to $23.
You are a member of the settlement class if you used a credit card or debit card to pay for parking at the main parking garage or any surface lot — economy, short-term, or long-term — at Dayton International Airport between October 14, 2014 and October 14, 2016, and received an electronically printed paper receipt for that transaction.
Eligibility is tied to a card transaction during that two-year window. Customers who paid with cash, or whose receipts did not display card information, are not part of the class.
Each approved claimant receives a voucher worth up to $23 in parking, redeemable at the Dayton International Airport parking exit stations. If you do not want to be legally bound by the settlement, you can exclude yourself (opt out) by sending a written request for exclusion to the Claims Administrator by the deadline stated on the official settlement website. If you exclude yourself, you keep any right to sue SP Plus separately over these claims, but you give up the voucher. If you stay in the class, you may also object to the settlement's terms before the court decides whether to grant final approval. Doing nothing means you stay in the class but will not receive a voucher unless you file a claim.
No legitimate settlement administrator will ask you to pay a fee or hand over a full bank account or card number to release a parking voucher. File only through the official settlement website linked on this page, and ignore unsolicited calls, texts, or emails that demand payment or sensitive financial details to "verify" your claim.
