What is the Home Partners Settlement About?

You may be part of a new $34,000,000 class action settlement reached with Home Partners Holdings LLC and related entities over allegations that their leases included misleading or unlawful provisions, including repair and maintenance obligations.

Home Partners denies all wrongdoing and no court has decided the merits. If the Court grants final approval, eligible Lease Households will receive an automatic base payment, and households may also request an additional reimbursement for qualifying repair and maintenance expenses by submitting a claim.

What is the Total Settlement Amount?

The class action settlement fund for the Home partners lawsuit is $34,000,000. After Court-approved attorneys' fees, costs, administration expenses, and service awards are deducted, the remaining Net Settlement Fund will be used to pay automatic Pro Rata Base Payments and approved Repair and Maintenance Cost Reimbursement claims.

Who Is Included in the Class Action?

The class includes tenants, household members, and listed occupants who lived in a Home Partners home during the Settlement Class Periods. The multistate class covers all states and the District of Columbia except Minnesota, Washington, and Colorado from December 22, 2019 through July 31, 2025. Minnesota covers March 1, 2016 through July 31, 2025. Washington covers September 21, 2016 through July 31, 2025. Colorado covers May 1, 2017 through July 31, 2025. You are not in the class if you timely opt out, first began renting on or after January 10, 2025, were a minor at preliminary approval, are an employee or officer of defendants or their affiliates, or are judicial personnel assigned to the case and their immediate families.

How Much Can I Get Paid?

Payments come from a $34,000,000 fund, subject to Court approval of fees, costs, and service awards. All Lease Households that do not opt out are eligible for a Pro Rata Base Payment with no claim required. The amount is based on your household's total monthly base rent paid through July 31, 2025 relative to the total paid by all class members.

A separate $7,500,000 pool of money will be intended to reimburse up to $2,500 per Lease Household for repairs you performed or paid for that you contend were Home Partners responsibility and for which you were not reimbursed. If approved repair claims exceed $7,500,000, payments will be reduced proportionally. If total approved repair claims are less than $7,500,000, the unused amount is added back to the base payment pool.

How Do I File a Claim?

To request a Repair and Maintenance Cost Reimbursement you must submit a claim online at HPASettlement.com by October 27, 2025.

You may be asked to provide documentation of the repair costs you paid and attest that you were not reimbursed. Each Lease Household may seek up to $2,500, subject to the $7.5 million cap.

How Will I Be Paid?

Current Residents may receive a ledger credit toward rent or request a direct check using the Claim and Change of Address Form on the settlement website. If any Settlement Class Member in a Lease Household requests a check and others do not, checks will be issued to each Settlement Class Member in that household.

If you owe more than three times your monthly base rent, your payment may be limited to a credit. Late-Term Residents, meaning those with fewer than 60 days left on their lease as of the Effective Date, may request a check, though balances of three times or more monthly base rent may still lead to a ledger credit.

Former residents are expected to receive payment by check, and if you owe more than one month of base rent your balance will be reduced by your payment first. If your account was sent to collections, the collection agency will be instructed to reduce the debt by your settlement payment.

What Are My Options?

You may do nothing and receive the Base Payment if the settlement is approved. You may submit a claim for repair reimbursement by October 27, 2025. You may opt out by October 20, 2025 and bring your own case, but you will not receive settlement money. You may object by October 20, 2025 if you disagree with the settlement but wish to remain in the class.

How Do I File a Claim?

No claim is required for the automatic Base Payment. To request a Repair and Maintenance Cost Reimbursement, submit a claim and provide documentation of the repairs and out-of-pocket costs that were not reimbursed. Current Residents may also use the Claim and Change of Address Form on the site to request a check instead of a ledger credit if eligible.

What is the Claim Form Deadline?

The deadline to submit a Repair and Maintenance Cost Reimbursement claim is October 27, 2025.

Is Proof Required to File a Claim?

No proof is required to receive the automatic Base Payment. Proof is required for the Repair and Maintenance Cost Reimbursement claim, which generally includes receipts or records showing the work performed, amounts paid, and that you were not reimbursed. You will need to attest to the accuracy of your submission, and you may be asked for additional documentation if necessary.

Payments will be distributed only after the Court grants final approval and any appeals are resolved. There is no specific payment date yet. Timing updates will be posted

Attorney Fees, Costs, and Service Awards

Class Counsel will seek up to $11,300,000 in fees, approximately $1,175,000 in litigation expenses, an estimated $200,000 for notice and administration, and $105,000 in service awards for the Class Representatives, subject to Court approval.

These amounts will be paid from the Settlement Fund. You can review the fee motion on the settlement website after October 14, 2025 and you may object to fees and costs even if you support the other terms.
