Pfizer will pay $44 million to resolve claims that its stop-smoking drug Chantix contained an undisclosed nitrosamine impurity. Pfizer denies any wrongdoing.
Pfizer, Inc. has agreed to pay $44,000,000 to settle a putative class action claiming that its branded stop-smoking drug Chantix (varenicline) contained an undisclosed nitrosamine impurity and that Pfizer misrepresented its adherence to current Good Manufacturing Practices in making the drug. The case is In re Chantix (Varenicline) Marketing, Sales Practices and Products Liability Litigation (No. II), No. 22-MD-3050 (KPF), before Judge Katherine Polk Failla in the U.S. District Court for the Southern District of New York.
Pfizer believes it did nothing wrong and denies violating any law. It agreed to the Settlement to avoid the uncertainties and expenses of continued litigation, and the Court has not decided who is right. The Court granted preliminary approval on June 1, 2026, and notice went out to the class in July 2026. Claims are now open.

Who Qualifies?
The Settlement Class includes all individuals and third-party payors who paid any amount of money for retail purchases of Chantix in the United States and its territories from September 29, 2015 through September 17, 2021. If you filled a Chantix prescription and paid anything toward it during that window — a copay, coinsurance, or a deductible amount — you are covered.
Several groups are excluded and cannot file a claim, even if they otherwise fit the definition: any officer, director, manager, or employee of Pfizer; government agencies or governmental actors, including any state Attorney General office; anyone whose only Chantix purchases fell before September 29, 2015 or after September 17, 2021; and anyone who previously opted out of the Settlement Class in this case.
The Settlement covers only Pfizer-brand Chantix, not generic varenicline made by other manufacturers. There are two ways to claim: an Individual Consumer Claim Form for people who paid out of pocket, and a separate Third-Party Payor Claim Form for health plans, insurers, and other entities that paid or reimbursed for Chantix. Use the form that matches who you are.
How Much Can You Get?
Pfizer is paying a total of $44,000,000. After the Court deducts attorneys' fees, litigation expenses, notice and administration costs, and any class representative service awards, the remaining net fund is split: up to 20% goes to the consumer class, and the rest goes to third-party payors.
Each consumer who submits a valid claim receives a pro rata share of the consumer pool, calculated from the out-of-pocket amount they paid for Chantix during the class period. No consumer's payment will be more than the total they actually paid for the drug. Third-party payors are paid pro rata from the remainder based on their qualifying, documented payments. Because payments are pro rata, the exact per-person amount will not be known until all valid claims are counted after the deadline.
Payments are sent digitally by default, so the claim form asks for a valid email address and mobile phone number unless you affirmatively choose another payment method.
How to File a Claim
You can file online through the official settlement website, ChantixSettlement.com, or download a paper Claim Form and mail it so it is postmarked by the deadline. Consumers should use the Consumer Claim Form; third-party payors should use the TPP Claim Form and submit supporting claims data.
On the consumer form you confirm you are a class member, then provide the number of Chantix prescriptions you purchased and your total out-of-pocket cost from September 29, 2015 through September 17, 2021. You do not need to attach documentation when you file, but the Settlement Administrator may ask for proof later — an explanation of benefits from your insurer, pharmacy records, or copies of prescription records showing you paid for Chantix. Keep those records until your payment arrives.
Your Other Options and Key Dates
If you do nothing, you will not receive a payment and you will give up your right to sue Pfizer over the claims in this case. You have until September 14, 2026 to exclude yourself (opt out) if you want to keep your right to sue, or to object if you want to tell the Court why you do not like the Settlement. The Court will hold its Final Approval Hearing on October 13, 2026 at 3:00 p.m. in Courtroom 618 of the Southern District of New York; you may attend but are not required to.

What is the deadline?
Claim Forms must be submitted online or postmarked by September 14, 2026. That is also the deadline to opt out or object. The Final Approval Hearing is October 13, 2026.
