What's the Realogy Telemarketing Settlement?

If you received unsolicited calls from Coldwell Banker-affiliated real estate agents between June 11, 2015, and December 3, 2020 you may be owed an estimated $281.00. Realogy Holdings Corp. (now Anywhere Real Estate) has settled a class action over allegations that Realogy violated the Telephone Consumer Protection Act (TCPA) by making telemarketing calls to numbers on the National Do Not Call Registry and may have been using prerecorded voice messages without consent.

What is the Total Settlement Amount?

The total settlement fund is $20 million, which covers payments to class members, attorneys’ fees and expenses, settlement administration costs, and service awards to class representatives

What is the TCPA? How Does it Protect Consumers?

The Telephone Consumer Protection Act (TCPA), passed in 1991, regulates telemarketing, automated calls, texts, and prerecorded messages. It requires prior consent from consumers before such communications and provides penalties for violations. For more details, check out the OpenClassActions blog post on TCPA.

How Do I Qualify For a Payout?

You may be eligible if you:

• Received two or more calls within any 12-month period from a Coldwell Banker-affiliated agent, using Mojo, PhoneBurner, or Storm dialers, to a phone number listed on the National Do Not Call Registry for at least 31 days; or

• Received at least one call from a Coldwell Banker-affiliated agent that included an artificial or prerecorded voice message, as identified by specific call disposition codes, between June 11, 2015, and December 3, 2020
