What Was the Case About?
Plaintiffs alleged that fuboTV collected, stored, used, distributed or retained subscribers' personally identifiable information in violation of the federal Video Privacy Protection Act, California's Invasion of Privacy Act, and California Civil Code § 1799.3, which restricts how subscriber data may be shared. fuboTV agreed to the settlement to resolve the claims; it is not an admission of wrongdoing.The VPPA is a 1988 federal law limiting how a video service provider may disclose information identifying what a consumer watched. It has become the basis for a wave of cases against streaming services and publishers whose pages carried third-party advertising trackers.
Who Was Covered?
The class covered anyone in the United States or its territories who had a fuboTV account, or used another person's fuboTV account, on or before May 29, 2025. Notably, account holders were not the only eligible group — people who watched using someone else's account were covered too. Excluded parties included fuboTV employees, affiliates and others specified in the notice.How Much Could Claimants Get?
Each approved claimant was to receive an equal share of the $3.4 million fund after court-approved deductions for attorneys' fees of up to $1.36 million, service awards of up to $12,500 in total, and administration costs. California residents who provided the additional certification were eligible for an estimated 10 percent premium on top of the base share. Because payment was an equal split rather than a fixed amount, the per-person figure depended entirely on how many valid claims were approved.What Proof Was Required?
Filing online required a Notice ID. A class member who did not receive one but believed they qualified could mail a paper claim form and supply the email address used to access fubo during the covered period. Claimants also had to attest that they had a fuboTV account, or used another person's account, on or before May 29, 2025 while residing in the U.S. or its territories. California residents had to provide additional certifications to receive the enhanced payment.
