This article describes a class action complaint. The statements below are unproven allegations. Start Gimme, LLC (Gimme Care) has not been found liable, there is no certified class, and nothing to claim at this time. This page is informational and is not legal advice.

What Is This About?

A proposed class action filed October 21, 2026 accuses Start Gimme, LLC, which does business as Gimme Care, of sharing the health information of people who used its website with advertising and analytics companies. The case, Maddocks v. Start Gimme, LLC d/b/a Gimme Care, No. 8:26-cv-03195, is pending in the U.S. District Court for the Middle District of Florida in Tampa.

Gimme Care sells compounded peptide products online, including compounded tirzepatide and semaglutide (GLP-1 weight-loss drugs), sermorelin, glutathione and NAD+, and ships them to customers’ homes after an online medical intake questionnaire. The complaint, which says the company was formed in May 2025, alleges that tracking code from Meta, TikTok, Reddit, Criteo and Microsoft ran on the site’s treatment pages, intake questionnaire and checkout, and passed along what users disclosed. These are allegations; Gimme Care has not responded in court.

What the Complaint Says Was Shared

According to the complaint, users must reveal the treatment they want, most often a GLP-1 weight-loss program, and answer a medical questionnaire about their height, weight, medical history, current medications and prior GLP-1 use, then enter their name, email address, phone number, date of birth and shipping and billing addresses to buy. The complaint alleges this happens before users are asked to review any privacy policy, and that nowhere on those pages are they told the tracking is happening.

The suit alleges that the Meta Pixel, TikTok Pixel, Reddit Pixel, Criteo OneTag and Microsoft UET tag captured page views, the text of the answer buttons users clicked on medical questions, and identifiers such as hashed email addresses and phone numbers, and sent them to those companies in real time. The plaintiff, a Florida resident, says he used the site in or around March 2026 to buy compounded tirzepatide and that his questionnaire answers were transmitted this way.

The complaint points to earlier federal enforcement over health data and ad trackers, including the Federal Trade Commission’s actions against BetterHelp, GoodRx and Cerebral and a July 2023 joint FTC and HHS warning letter to hospitals and telehealth providers, and argues those warnings predate the company’s formation.

The Proposed Classes and Legal Claims

The suit seeks to represent a nationwide class of people in the United States who, during the class period, used the Gimme Care website to view treatment information, submit an intake questionnaire or buy a medication or treatment, and whose communications were sent to third parties through the tracking tools. It also proposes a Florida subclass of class members who used the site while in Florida.

It asserts five claims:
The plaintiff asks for class certification; statutory or actual damages under the federal wiretap law, which allows the greater of $100 a day per violation or $10,000; statutory damages under the Florida act; an order barring the tracking without notice and consent and requiring Gimme Care and its vendors to destroy the data collected; attorneys’ fees; and a jury trial. The case was filed by Almeida Law Group LLC.

Part of a Wave of Health-Tracking Suits

Lawsuits over pixels on health websites have targeted hospitals, telehealth companies and insurers. OpenClassActions.com is also tracking the Mercy Health website tracking lawsuit, the Health First tracking lawsuit and the Hims & Hers health data sharing case. Some earlier health-pixel cases have settled, including GoodRx’s $32 million privacy settlement.

What Happens Next

Gimme Care has not yet responded to the complaint. Defendants in website-tracking cases commonly move to dismiss, arguing that the data shared was not the content of a communication or that users consented through a privacy policy. If the case survives, it would move to discovery and, later, a decision on class certification. Nothing is payable unless the case settles or the plaintiff wins.

Questions

Is there a Gimme Care settlement?

No. As of October 22, 2026 the case is at the complaint stage. There is no settlement, no settlement fund and no claim form, and no class has been certified. The lawsuit was filed October 21, 2026.

What does the Gimme Care lawsuit allege?

The complaint alleges that Gimme Care placed the Meta Pixel, TikTok Pixel, Reddit Pixel, Criteo OneTag and Microsoft UET tag on its website, including its medical intake questionnaire and checkout pages, and that those tools sent users’ treatment choices, questionnaire answers about height, weight, medications and medical history, and identifiers such as email addresses and phone numbers to the third parties without users’ knowledge or consent. Gimme Care has not responded in court, and the claims are unproven.

Who would be in the proposed class?

The complaint proposes a nationwide class of people in the United States who used the Gimme Care website to view treatment information, submit an intake questionnaire or buy a medication or treatment, and whose communications were sent to third parties through the tracking tools, plus a Florida subclass of class members who used the site while in Florida. A court has not certified either class.

What laws does the Gimme Care lawsuit cite?

The complaint asserts claims under the federal Electronic Communications Privacy Act, the Florida Security of Communications Act and the Florida Deceptive and Unfair Trade Practices Act, along with intrusion upon seclusion and unjust enrichment. It seeks statutory and actual damages, an order requiring consent before tracking and deletion of the collected data, and a jury trial.
